Orly Taitz asks Land to recuse himself
edger- enquirer.com ^ | October 4, 2009 | ALAN RIQUELMY

Attorney Orly Taitz, the “birther” lawyer under threat of sanctions by U.S. District Court Judge Clay Land for filing a “frivolous” lawsuit, filed a motion Friday asking the judge to recuse himself because of personal contacts and financial stakes he may have with President Barack Obama’s administration.

Land was appointed to the bench by President George W. Bush.

Taitz represented Army Capt. Connie Rhodes when she filed a Sept. 4 complaint arguing Rhodes shouldn’t be deployed to Iraq because Obama couldn’t legitimately hold office. Land not only ruled against Rhodes, but ordered Taitz to explain why he should not fine her $10,000 for filing a “frivolous” lawsuit.

On Friday, Taitz asked for an extension to respond to that order, but also asked that Land recuse himself from the case. In her motion for recusal, Taitz:

* States Land may have improperly been in contact with U.S. Attorney General Eric Holder.

* States that Land’s ownership of stock in Microsoft and Comcast could give the judge a financial stake in the outcome.

* Likens her plight to that of the late civil rights icon Thurgood Marshall in the 1940s and ’50s.

“The primary reason for the undersigned counsel to file this motion to recuse, however, is that Judge Clay D. Land has by his own actions created a constitutionally intolerable situation in which he is both complaining party, prosecuting attorney, judge and jury regarding the charges of frivolous filing and sanctionable conduct which he has leveled ...” Taitz states.

“What, for example, was ever more political in 20th century Georgia than the question of school desegregation?” Taitz asks. “Surely this distinguished southern judge would have jailed Thurgood Marshall in the 1940s and ’50s for contempt when the future Supreme Court justice repeatedly filed cases demanding on constitutional as well as ...

They’d all have egg on their face, some worse than others. Thing is, the country cannot go forward, IMO, until the issue is fully and openly addressed.

The public’s trust in Obama is very low. Everyone I speak to has sincere doubts about his ability and well as eligibility to hold office.

Are we a constitutional republic or not. I believe we are and we need to establish that all are subject to the law, Polanski and Obama.

“They aren’t conservatives.”

Some of the Orly-bashers date back to the first year of this website, 1998.
I think they really are conservatives, but they have some weird psychological aversion to supporting what they believe is a “lost cause”. In a struggle between good and evil, they hurl catcalls against the good because they are sure evil will triumph. They have already psychologically surrendered to Obama, and abuse someone who has not.

Some people have been registered a long time but are - strange - and seem to have psychological problems. As in they enjoy demoralizaing those who want 0bama’s fraud revealed.

Just how big of a mess would this actually create?

We would find out how Americans value the Constitution and whether it's really relevant at all anymore. Then it would all be worth it.

Land’s probably corrupt but Orly’s comment about Marshall is pretty dense considering she’s going after the first black president!!!

I wonder really, just how the media (including) Fox would react if this all came to pass ....how they would react?

I mean, come on... in a single instant anyone who ignored this, ... would be reduced to what?

And how would America react or better yet how would the world react?

Let me answer you with a time machine.

Pretend such a thing happened tomorrow. Speed forward one year from now...and you are here.

The answer you seek is in front of you.

This is what it would look like. This is how they handle the fact that he cannot prove it.

This is what Taitz etal don't get. She's trying to prove the sky is blue. Everyone already knows it.

They simply don't care.

So....now what? Nothing. That's what. Same as with GM takeover. etcetc. This is not Lexington Green anymore. We get a bunch of people milling about in DC as if they were liberals protesting something. But that's about the extent of it.

I would love nothing more than to see him disqualified in the face of an enormous democratic party coverup-uncovered, the one most all who follow this story knows would likely unfold.

I just don’t see anyway to get there from here...

My take so far,

Either the left knows it, (including the MSM and the liberals on the courts) suspect it and thousands of people are complicit in this fraud. In which case once it came to light and into the realm of the high courts. Hundreds, if not thousands of people, many who hold very high offices in the land would potentially (who are we kidding... most likely) be indicted.

So the left knowing this would just assume die than risk the uber gi-normous sized scandal so they simply continue to do what they did to get him elected... to continue the coverup.

Or another possibility, the left, again to include the MSM and the liberal courts suspect that as far fetched and perverse as it might seem, it “could” theoretically be true and that leaves them to ponder the unquestionable.

What would happen constitutionally if even a vanilla flavored hint of this was to come to light as being true.

Would it (not) just stop with Obama, what about the question of the whole ticket? Was Joe Biden complicit in this as well, if so is he disqualified from his office?

How many Campaign and WH Senior Staffers knew and who under them knew?

And then we start down the list in order of the Chain Of Succession, deposing the heck out of any and all and what if they are found to be in on it, even if just in knowledge only?

At what point would it stop?

At some point we would begin to question the possibility that the entire chain of succession is completely tainted then what?

And what of the Military during all of this, who do they report to... does anyone really know?

What if the need for CIC level orders arrises, Iran attacks our interests in the Gulf, Russia moves on Eastern Europe, China on Taiwan or another 9/11 sized terror attack on US soil?

What about the race issues, one can easily imagine the Jackson’s, Farrakhan’s, Sharpton’s, Rev. Wright’s and Van Jone’s of this country whipping the minorities into a full blown violent rage against the perceived attack on the first black President.

I can see a openminded Judge pondering this question in his study late one evening. Concerned more about the Republic falling than the law. Speculating that it might be better to not kick over this rock and just let the people render him effectively useless once they take away his party dominated Congress in the mid term elections and then hopefully vote him out in 2012.

Or pondering on that should we enter into these uncharted waters and risk a ship wreck of unbelievable constitutional proportions one that could very well destroy this Republic.

I can see that happening, infact I bet it has already been pondered by the very judges and counselors who stand to be at the forefront of any future case and argument involving this matter.

Its actually scary when you ponder it all. We are in a bit of a pickle and those with intelligence knows it but those same people need to stop for a moment and ponder the impossible.

Not the impossible that we might elect a traitor, a foreign impostor to our highest office in this land. But the impossible thought that we may very well topple our own Republic for simply doing what is right, what is just and what would be expected of us, to simply uphold the law and demand justice.

This BC deal is just so unbelievable. Totally like how can his happen in USA - center for corruption and financial collapse for the world. I have my explanation on why he can't show his birth certificate: His medical records are sealed too P.S. Read with an open mind. If you are not familiar with Obama's detailed bio this may not make much sense.

“D.C. Tech Official Is Accused of Bribery(Birth Certificate Forgery)
A D.C. government official and a business executive were arrested yesterday on bribery
charges involving city technology contracts that included "ghost" workers and
kickbacks, federal authorities said. Until recently, the technology office was headed
by Vivek Kundra, who has taken a job as President Obama's chief information officer.
A White House official confirmed last night that Kundra has taken a leave of absence.
“Yusuf Acar, 40, who has worked in the technology office since 2004, was charged with
bribery, conspiracy, money laundering and conflict of interest.
Assistant U.S. Attorney Thomas Hibarger told a federal judge that Acar is a flight risk because agents
seized $70,000 in cash in his house and because in recorded conversations, he boasted that he could easily flee to his native Turkey.
Acar also told the informant that he could use
computers to create fake D.C. birth certificates, Hibarger said. “

Orly is the only one doing anything in the birther arena these days.

Well, yes, a contempt citation is pretty much a judge acting as judge, jury, and executioner. She can appeal contempt to the next level if she wants. Judges don't usually recuse themselves every time a lawyer is found in contempt of their court.

Sure, let's play the race card. We all know how much we love that one.

Win or lose, Orly Taitz is an American hero

No, she's an incompetent nut.

There's a difference.

snip....
“Since the undersigned certainly did not invent or ever adopt the term ‘birther,’ awareness of this label is a pejorative appellation (often coupled with even more colorful epithets such as ‘bats—t crazy’), and since she does not go around introducing herself or her clients as part of a ‘movement’ in any sense, certainly not in court, it can only be concluded that Judge Clay D. Land has derived his information, and prejudice, and bias, against the undersigned by reference to material which is exclusively available from extrajudicial sources,” Taitz states. ...end snip

“bats..t crazy” LOL.

Orly is good for a laugh or two each time she appears at some location. Bless heart little ‘pea picking heart’.

“No, she’s an incompetent nut.”

I refer other Freepers to your “about” page, so they can see from whence this definitive criticism comes.

I guess you have degrees in law and psychiatry, and are just rendering your expert opinion.

I’m just an American citizen, worried about his children’s future, and to me Orly Taitz is a hero. Her courage and tenacity in the face of adversity is amazing and inspring.

“I guess you have degrees in law and psychiatry, and are just rendering your expert opinion.”

Do I need those degrees to have an opinion about this kook woman?

Does her record thus far require one to have a degree to see her incompetence?

Behold the brilliance of Orly Taitz:

What are YOUR expert qualifications? And as for my about page, it also indicates that I have been here many times longer than you. Know thy place, n00b.

Well first of all you are scarcely “humble”. So your web name is a bit of a fraud, isn’t it? Perhaps you might call it irony.

As to your link, sorry but I don’t watch your favorite channel, MSNBC. I’m a conservative. I think Orly Taitz certainly showed poor judgement in appearing on those communist TV networks. Give her time, maybe she’s learning the ropes. As I recall Sarah Palin was forced to appear on communist TV by John McCain and his campaign managers, but she’s also learned her lesson by now. Do you think Sarah Palin is a “nut” also?

By the way, I think that anyone who represents themselves as a scary cartoon figure holding a semiautomatic weapon, would be well advised not to call anyone else a “nut”.

As to my qualifications, I am a graduate of that same Ivy League cesspool that gave us our imposter President. I don’t plan to give them any money, but they don’t believe me. They keep on calling.

You are entitled to your ill-informed opinion. If Orly Taitz happens to be successful in bringing Obama to justice, I’m sure you will sing her praises. I praise her for her efforts right now, because no one else is doing anything to bring Obama to justice. Is she standing in the way of a crack team of lawyers who want to take the case? I hadn’t heard about it. Go Orly! Bring the communist imposter to justice!

As to all you catcalling naysayers, I am amazed there are so many of you, and ashamed that you are my fellow conservatives.

The link was to Youtube. Pay attention.

I praise her for her efforts right now

Did you praise her when she spelled her name wrong on a filing?

Did you praise her when she failed to sign a brief?

Praise away, she's still an incompetent nut who isn't qualified to run a taco truck.
