A Connecticut hotel where a woman was raped at gunpoint in front of her children says the victim was careless and negligent.
The papers filed last month in Superior Court by the Stamford Marriott Hotel & Spa say the victim "failed to exercise due care for her own safety and the safety of her children and proper use of her senses and facilities."
Prosecutors say Gary Fricker assaulted the woman in her minivan in the hotel's parking garage in front of her two children, then ages 3 and 5.

In all seriousness, I will never patronize the Mariott ever again. I will take a crusty economy motel any day.
Both sides are wrong. She should not be blaming the hotel and they should not be blaming her. As long as there is evil in the world there will be rapists who will find a way to do their deeds.

Here’s some more detail. Apparently the guy had been lurking in their parking garage for a couple of days beforehand without the hotel taking any action:

The hotel isn’t saying anything. This is their lawyers speaking, trying to reduce the amount of the judgement.
How about the assailants? Aren’t they the ones who have the blame and the responsibility for this?
Oh, I forgot. Assailants are almost always members of the “oppressed” class, but hotels are eeevvvviiiillll corporations with a lot of money.
The best defense against rape is awareness of your surroundings. I see women every day in parking lots walking too close to cars, talking on their cell phones, waiting to get right to their cars before digging for their keys. Cameras won’t protect you. Cops won’t get there in time. And even a gun is useless if you don’t see the guy coming.
I’m not blaming the victim for the rape. I’m blaming society for making her think that it’s the hotel’s fault just because it has deep pockets.

If the guy was known to have been hanging around like that and the hotel didn't deal with it, then, yes, the hotel bears a great deal of responsibility.
There is no explanation as to what the hotel did. The hotel is not blaming the victim. They are defending themselves. If responsibility has to be assigned to one party, it would have to be the one who was actually there. Unless Marriott does something to encourage rapist to frequent their properties. Was there a rapist conference or convention being held there?
Yikes, see post #6. I think I jumped to a conclusion I shouldn’t have. Sorry, but the original article was written like crap. This woman may actually have a case.
Typical insurance defense attorney stuff. While everybody’s jumping on tort reform, the real abuse of the system comes from the defendant’s side. That is why insurance companies and banks don’t want 12 everyday Americans passing judgment on them.

I disagree. The woman is wrong. The Hotel is defending its self from an unwarranted attack.
I dont know the womans background but no one should expect to be safe in a hotel parking garage unless you are paying $1000 a night for a hotel with securty. Even then you better keep an eye on the guards.
Would be interested to know how she or her attorneys knew that and if the person who told them reported the sightings.
PS: Unless she knows how to move through the garage like SWAT, I don’t know how she can walk with two kids and prevent someone from coming up behind her. I wonder what the hotel thinks she did wrong other than to stay at a Mariott.
How is the hotel at fault here? Without knowing the details, it appears the only reason she is suing them is because they have money. If somebody stays at your house one night and then gets attacked in the driveway the next morning by some criminal should you be liable?
Sounds like there are some major details missing or the attorneys are nuts. What does the kids babysitter, her Pilates instructor and tennis partners have to do with her getting raped in a hotel parking garage?
