Is she trying to blame the hotel?

Was the manager a taliban cleric?

In all seriousness, I will never patronize the Mariott ever again. I will take a crusty economy motel any day.

Both sides are wrong. She should not be blaming the hotel and they should not be blaming her. As long as there is evil in the world there will be rapists who will find a way to do their deeds.

Here’s some more detail. Apparently the guy had been lurking in their parking garage for a couple of days beforehand without the hotel taking any action:

The hotel isn’t saying anything. This is their lawyers speaking, trying to reduce the amount of the judgement.
How about the assailants? Aren’t they the ones who have the blame and the responsibility for this?
Oh, I forgot. Assailants are almost always members of the “oppressed” class, but hotels are eeevvvviiiillll corporations with a lot of money.

the victim was careless and negligent.

I'd like to know on what grounds she was considered careless and negligent by the Stamford Marriott. The fact that she chose to stay at their hotel?

There is no explanation as to what the hotel did. The hotel is not blaming the victim. They are defending themselves. If responsibility has to be assigned to one party, it would have to be the one who was actually there. Unless Marriott does something to encourage rapist to frequent their properties. Was there a rapist conference or convention being held there?

Typical insurance defense attorney stuff. While everybody’s jumping on tort reform, the real abuse of the system comes from the defendant’s side. That is why insurance companies and banks don’t want 12 everyday Americans passing judgment on them.

parsy, who says this isn’t news at all to those who work with it.

I’m going to vote for the victim here.

If I stay at a hotel, I expect that my security is part of the package deal. I will take normal care, but I expect the hotel also to do their job in keeping me safe.

If I get robbed in their hotel, including in their parking lot, they are going to hear from me. I expect them to secure the parking garage; after all, my car is there and I expect it to be there undamaged when I return.

If they skimp on security then they are asking for consequences. If they’ve done everything that could reasonably be done, and something bad happens anyway, then I would hold them blameless. That would be their hurdle to prove.

WHY is everyone in this thread ignoring the THIRD leg of this stool: the poor RAPER?

A little compassion should be shown this man (it IS a man; right?) here!

After all; he may have been LURKING the garage, trying to overhear folks talking about the PORNO film they’d watched in their room the night before.

He may have been unable to AFFORD a Marriott room and has had to stay in CRUSTY hotels (See’s seen the expose’s on TV about them).

He was born on the wrong side of then tracks, under-educated by our public schools, treated badly by voting officials, his dog died when he was young an he’d been abused as a child too boot!

HE’s the ‘victim’ here!!!

(and women probably didn’t find him(?) attractive; either.)

It's Connecticut. She'll win...Marriot will lose.I'm surprised that she's not suing Ford as well. After all,the rapist drove a Ford to the place where the rape took place.

(end sarcasm)
