Heres some more detail. Apparently the guy had been lurking in their parking garage for a couple of days beforehand without the hotel taking any action: The link isn't working for me.
If the guy was known to have been hanging around like that and the hotel didn't deal with it, then, yes, the hotel bears a great deal of responsibility.

The woman, identified in court papers only as Jane Doe, claims in the suit that Fricker had been in the hotel and garage acting suspiciously days before the attack, as well as the afternoon of the attack, and the hotel failed to notice him, apprehend him or make him leave.
Would be interested to know how she or her attorneys knew that and if the person who told them reported the sightings.

The hotel also subpoenaed several people involved with the family, including a Pilates instructor, friends, tennis partners and the children's baby sitter. The woman's attorneys argue the individuals subpoenaed do not know anything about the attack, that the subpoenas inadvertently identified her to those people and that it was merely an effort by the hotel's attorneys to intimidate her. Sounds like there are some major details missing or the attorneys are nuts. What does the kids babysitter, her Pilates instructor and tennis partners have to do with her getting raped in a hotel parking garage?
