I'm thinking about pursuing hate crime charges against a group of black women who assaulted me tonight because I stuck up for a disabled white man who stumbled.
I found out that I can get them charged with a hate crime per Minnesota Statute Minn. Stat. § 609.2231
I'm wondering if the perps get caught, if I can get some support from the Freep
(Excerpt) Read more at none ...
That’s nice of you to share.
If you believe a crime (hateful or not) has been committed; pick up your phone and contact the police.
It’s that simple.
Interference with you rendering aid to a an accident victim. Tough one. It might be harder to prosecute if you threw race into it.
I prefer people be prosecuted for their actual actions. If the women did something illegal, have them arrested. What was in their minds is quite irrelevant to the proceedings, IMHO.
Good for you for being calm and cool. I would of blasted them straight in the face.
“What was in their minds is quite irrelevant to the proceedings, IMHO”
Motive is 1 of the 2 basic components you have to establish and prove to achieve a conviction.
http://en.wikipedia.org/wiki/Mens_rea
“In criminal law, mens rea the Latin term for “guilty mind”[1] is usually one of the necessary elements of a crime. The standard common law test of criminal liability is usually expressed in the Latin phrase, actus non facit reum nisi mens sit rea, which means that “the act does not make a person guilty unless the mind is also guilty”. Thus, in jurisdictions with due process, there must be an actus reus accompanied by some level of mens rea to constitute the crime with which the defendant is charged (see the technical requirement of concurrence). The Criminal Law does not usually apply to a person who has acted with the absence of mental fault; this is a general rule”
Under your state laws cannot the women be charged with at least assault for their actions toward you?
Did they do anything prior to that which would lead to their actions toward you? (Was there an assault against the crippled guy?)
OR:
Was your 'standing up' a reaction to clear words or action on the part of the perps? In that case, their crime might be inciting violence, or preventing aid, based on the crippled guy's race.
But:
Proving any of the above would literally mean you had a greater number of sympathetic witnesses than they did, and that's not likely.
OH:
Yeah;
What kind of support can any of us provide over the internet?
PS:
Believe it or not (it's difficult for me) you might do best with a letters to the editor campaign publicizing the events and editorializing on the value of [conservative] individual worth and humanitarianism versus [liberal] group entitlement/victimhood and assigned guilt.
“I commend your independence of thought. If I may ask you: what percentage of black Americans do you suppose think like you? And, what do you suppose it will take to convince black Americans of the worth of conservative views? I am very much interested in your answer. Thanks!”
Let’s see... Larry Elder, Thomas Sowell, Michael King, Michael Steele. We used to have Colin Powell, but we all know how that turned out.
“I prefer people be prosecuted for their actual actions. If the women did something illegal, have them arrested. What was in their minds is quite irrelevant to the proceedings, IMHO.”
Personally, I agree with you, but this could be a way to turn the laws on their side and show how absurd these laws are.
“Although I have the strong feeling that ‘hate crimes’ are actually targeted at.....me, I think I agree with Miltie. However, where a person’s thoughts actually do lead to illegal actions, you might note that linkage to support prosecution of/for their actions.”
I’m not that much of a fan of hate crimes either, but as long as they exist, they need to be applied equally. Why not use something your tax dollars are paying for?

Nope.

Yes and yes. if caught, they’re going to be charged with 5th degree assault. I’m getting a call from the investigator tomorrow. Everything was caught on video on the bus.

Videocameras have no emotions nor sympathies.

Hmmm... good point. Well, other than prayers, most of you are just words on a screen.

I’ve known the editor of the Northstar Writing Group for nearly 10 years now. I think I can get it in.
I’ll post an update.
Thanks for rendering aid to a stranger in need. Blessings your way.
GO ARMED!!!
Hate crimes are crimes of thought. kind of like 1984, Brave New World etc.
There are only crimes. Hate Crimes are bogus.
Unfortunately, I’m a citizen of Minnesota, the state where nothing is allowed. Also too, I had a girlfriend from the past slap a fake VAWA charge on me and I’m on probation. So pretty much I can do nothing. Pepper spray looks attractive.
P.S. Like I said before, even though hate crimes are fundamentally flawed, they’re there and it’s time we start fighting the race industry’s fire with our fire.
You are going to gum up the statistics so I doubt it will work.
Yes,insist that assault charges be brought against them for what they did to you.But I'd give up on any "hate crime" charges.
Just my 2 cents' worth....
To play devil’s advocate, they also did make fun of me for “talking white” and mocked me for being of mixed race.
But anyway, thanks for reminding me that I’m in the Land of 10,000 Laws and Excuses. A black on black hate crime will float like a lead balloon.
Not really, if you buy into the whole 'hate' crime thing.
