My question to you all is, what is the correct answer here? According to this Ormond Beach police officer, I'm breaking the law by just possessing the spud gun, but I don't think he's citing the right law here. What do you think?

So make a spud gun that just uses compressed air. No propellant, i.e. hairspray. I found detailed plans on the internet years ago. I’m going to see if they are still around. I’ll post the link if I find it.

The law is whatever the law-enforcers you run into say it is.

My bet is the BATFE might burn your house down with you and your family in it for even thinking about a spud gun.

technically, the potato could be a missile and the spud gun a missile launcher...if you really want to zoom out...

I saw a PVC potatoe gun in Minnesota once that shot the potatoe halfway across this good sized lake. They used lighter fluid. I would think there’s ordinances - these things are as good as a mortar.

Concealed carry is probably out.

I read the statute as follows:

1. Potato guns using propellant are prohibited by this statute, and possessing such would be a felony.

2. As such, potatoes are also prohibited by the statute, and their possession is also a felony.

I applaud you for the research. Since the state statute says it's a felony, I wouldn't want to lose my right to vote, based a clowning around with a homemade potato gun.

As a guy, I do agree that it would more fun than all get-out to blast spuds hundreds of yards through the air, if you didn't get caught and prosecuted.

I'd say go ahead and use it but not against your neighbors. If the cops bust you then plead ignorance. Its unlikely you'll do any jail time as long as its your first offense.

But be careful, you could put an eye out with that thing.........

I think your best bet is to assume that your spud gun is illegal. It may not be, but the sense of rebellion and thumbing your nose at “the man” will make your spud shooting all the more enjoyable!

And, if you’re using Idaho potatoes for example, you could be charged with bringing a potato across state lines for immoral purposes.

Btw, I’m pretty sure that somewhere, a Democrat is working on a law to require the registration of all potatoes.

This thread struck a chord with me. Many years ago, before I was Homer, I posted a potato gun thread. I will search it out and ping you. I don’t remember what state was involved.

Dang. I found it but it is locked and read-only. If you want to track it down it is titled, “Man Arrested after threatening to shoot potato into girlfriend.” Post date 3/15/01, by SepSchooler. (I was more serious back then.)

i live in holly hill and i wouldn’t take any chances. i would consult a lawyer and have him find you the correct law to have in your possesion...the law enforcement agencys are to quick to interpret the laws to fit them anymore and let you worry about hashing it out in the courts at great expense.

Given the definitions of “destructive device”, I think the cop is mistaken in classifying a spud gun as one. It’s not meant to blow up, it’s meant to serve as a launching platform.

I think the bore is what will get you into trouble here and activate that law you got from the Ormond Beach LEO. Check the 9/12/01+ changes in state and Federal law to see if the broad brush reaction to 9-11 has reclassified your toy into a WMD.
