I am 2 hours post-op surgery.
The last words I heard before going under anesthesia were: "Quit Smoking"..from the anestheseologist.
The first words I heard coming out of the anesthesia, again by the anestheseologist, were "QUIT SMOKING".
Please...no pros\cons of smoking. Perhaps I'm too close to the surgery but, smoking now dries out my mouth, taste absolutely rotten and gives me a headache. I now have very little desire to smoke.
Please, no comments about no desire.
I don't think what the anestheseologist did is right. It's not his call to get me to quit smoking, it's mine...if and when I'm ready.
Is what he did legal ?
Whispering "Hillary Loves You!" would be offensive.
Whispering "Go Love Hillary" would be damaging!
Are you suggesting that when you are victimized, that you be a man and don't complain?

The heck it ain't! The question you asked about the legality of what the anesthesiologist said is ludicrous! Do you think he was just trying to get under your skin rather than give you advice you needed to hear so you wouldn't have to look at him in the near future?
If you're so "livid," it should be motivation for you to avoid a repeating of this event!

No, I'm just a pissed off patient who relates well to this particular sort of problem. I have been there, done that....and even though it was several years ago, I would still kick that little freaks A-- if I saw him on the street.
I do not believe that sound medical advice is victimizing anyone.
Suggesting that a patient take up smoking in a manner that bypasses free will would be vicitimizing.
But this doctor isn't saying anything that a good mommy wouldn't say. And you would sue over your momma's unwanted advice?
And with that ...ahem... other symptom you described, perhaps the doctor really was whispering something like that!
And while we're on the subject, is there an antidote to Viagra? It might be useful for HAS. (Hillary Arousal Syndrome)
It would be ever so nice if all this free advice, and in this case, free and unauthorized psycho therapy, was kept to one's self.

Oh yeah, you were the uninsured back patient who's condition didn't respond to treatment (which is not unusual) and then blamed the doc who didn't want to continue a protocol that wasn't working. Right?
But the doc should have continued and without gettin paid, right?

I don't approve of smoking. Cigarette smoke irritates my lungs. My father smoked two packs a day from the time he was 13 until he had a massive heart attack at age 56. The doctors gave him a year if he didn't stop smoking. My mom and I were planning the funeral. After all, he'd tried to quit many times before without success.
He never smoked another cigarette after he had his brush with death, and he is 82 years old now. I would have loved him every bit as much as I do now if he had never stopped smoking. I just wouldn't have enjoyed his company as long, and my four children would never have met him.
I do believe people have a right to smoke in their homes and cars. I believe that bar and restaurant owners should have the right to make theirs a smoking establishment. I wouldn't frequent them if they did, but they have the right.
But that is neither here nor there. I like to eat. I'm pro-food. But if the anesthesiologist had said "lose a few pounds" as he put the patient under, I'd still have the same position. There is no evidence that a "suggestion" like that would have any long-term effect on a person's behavior. If it did, why have gastric bypass surgery? No need to cut, just have the anesthesiologist whisper "stop overeating" while putting the patient under!
No civil rights were violated. No infringement on his autonomy occurred. The anesthesiologist's expression of his personal and/or professional opinion in no way violated the patient's right to choose whether or not to smoke. It only irritated him, which is unfortunate and not likely to be very productive. However, maybe this conversation will be. My dad is a retired Navy corpsman who served in WWII and Korea. The Marines called him and the other corpsmen "Doc." I'm sure he would recommend to our former Marine patient here to quit smoking. His loved ones will be happy he did.
My tirade is because people are not understanding that this nonsense happens all the time. This is the first time I have seen it done with smoking, but it is not surprising.
They do indeed screw with your head, and they do it a lot, because they are in a position to do so, and armed with all sorts of personal data on the patient because of the nature of their job.
I am in opposition to this data and ability to be used in a unauthorized fashion for any reason. Not just smoking.....
I think your disgust with smokers is blinding you to the rest, but that's OK. It is a common problem around here.
If anything, This thread has served as a warning to be aware of this.
What the person did was not only legal, but ethical, and completely within his rights and DUTIES of his profession.
When a doctor tells you to lose weight, quit smoking, decrease drinking, or stop molesting teenage boys, he is doing his job. This guy was doing HIS job. Stop whining and thank God that someone was sent into your life to help save it.
