Day 1996 photo that they believe indicates Karr was in Atlanta when the 6-year-old girl was killed in Colorado.
Gary Harris, an attorney for Karr's father, Wexford Karr, said Tuesday that the photo is of John Mark Karr's three children, along with a newborn nephew.
While John Mark Karr is not actually in the photo, family members "have no recollection of him missing a Christmas until the last five years," Harris said.
"They know that if his children were there, he would have been there," the attorney said. "They would have remembered it if they all had shown up and [John Mark Karr] had not shown up."
The nephew's presence in the photo is the basis for the family's belief that it was taken in 1996. Harris said the boy was born Dec. 11, 1996, and would have been bigger at any later Christmas gathering.
The photo, taken at Wexford Karr's home in Atlanta, was turned over to Boulder police investigators on Tuesday, Harris said. He said the family would not release the photo to the media to protect the privacy of the children in the picture.
Harris said John Mark Karr's family was living in Alabama in 1996 and had come to Atlanta for dinner on Christmas Day.
JonBenet Ramsey was killed that Christmas night in Boulder, and her body discovered the following day in the basement of the Ramseys' home.
Harris called "far-fetched" a law enforcement suggestion that Karr could have had dinner with the family, then flown to Boulder on Christmas afternoon.
"At the time this happened 10 years ago, [John Mark] Karr was living in Alabama with his family they were a unified family at that time and they had no money," Harris said. "It wasn't like he could just run out and buy a plane ticket. It doesn't make any sense."

Actually, it does do a few things even if Karr is not in the photo.
The infant nephew would verify that the photo was taken around the time in question. The presence of Karr's kids *in Atlanta* means that they went to see other family members which would add to the number of potential witnesses that could testify that they remember the trip and saw Karr in Atlanta on that Christmas day.
If they had chosen to spend a quiet Christmas at home in Alabama, just him and his family, there would be no other adult to testify to his being home other than his wife who, the prosecution could argue, might have a faulty memory or is trying to protect the accused. If there are three or four family members who recall Karr being in Atlanta that Christmas, it will be much harder for the prosecution to refute.
Keep in mind, too, that it is the prosecution that has to prove Karr was in Boulder, not the defense that has to prove he was not.
Even if they establish that Karr was far enough away from Boulder that he had to fly to get there for Christmas night, his presence on a commercial flight manifest would surely have to come next or, perhaps, proof that he rented a motel room, etc.
I know when I see my sister's family, I'm always taking pictures because of my nieces and nephew. But, when I visit my other sister's family, I often don't take pictures because they don't like having their picture taken. Some family dynamics are just that way.
I do hope the Karrs made a copy of the photo or found the negative before turning it over to BPD. Exculpatory evidence like that has a way of disappearing sometimes when a prosecutor is desperate for a conviction.

At best, it could be something to jog the memory of other family members who would remember him there, but sending it to the Boulder Police is pointless.

That's what most people are saying.
But this DA also made public statements that the CU football players caught up in the scandal were guilty of rape. Turned out she didn't even have enough evidence to file on them.
Whether he was in Boulder the night in question is key, obviously.
But if that's in doubt, the prosecutors would have to establish a nexus between Karr and Ramsey. Have you heard any thing about that? You just don't live in Alabama and pick up and fly to Colorado to randomly murder a child.
He had sons, so he probably wasn't on the beauty pageant circuit, he never lived in Colorado. How the heck did he know this kid even existed?
I wonder if his ex-wife knows more than she is saying....I remeber reading somewhere (unverified) that Karr had some pedo website and that his ex-wife knew about it and even posted there. It's possible that she and her family are trying to save their own skins.

Karr doesn't have to prove his innocence. The prosecution has to prove his guilt.

My take also.
All very good questions and ones I gave argued on other threads. The "tie" people claim is that Karr and the Ramseys are both from Atlanta but, prior to the murder, this is a tenuous link at best.
JonBenet was born in August, 1990. The Ramseys moved to Boulder in 1991. JonBenet could not have been more than one of 1,000s of infants in the Atlanta area at the time. For Karr to be "in love with" JonBenet, he would have needed to spend considerable time with her at a time when she is probably in Patsy's custody - or trusted family - practically 24/7.
Was JBR in Atlanta after the Ramseys moved? Yes. Patsy's sister was still in the area and the Ramseys travelled to Atlanta to see her and other acquaintances. JBR also competed in a child pageant in Atlanta in August, 1996 where she finished second.
Of course, by that time, Karr had moved to Alabama and started his own family. So how Karr would know the Ramseys and specifically JonBenet is hard to fathom although not impossible.
One other theory has been mentioned by another FReeper and I will bring it up only for speculative purposes because it makes everything else that happened fall into place. That being that JBR was already visible on the internet (or Usenet) through the pedophile underground and that the Ramseys were actually selling JBR out for in-house "visits" - probably not actual sex but something prurient. Karr was one of their customers, became overly excited, accidentally killed JBR and then the Ramseys participated in a cover up, fearing they would lose Burke too if the truth came out.
Makes all the pieces fit, doesn't it?
The problem, of course, is that it is disgusting and vile to think anyone would do that to their daughter, particularly Patsy who doted on her daughter so and John who had so much money that there was no need to essentially prostitute his daughter for a little extra cash. And to do it on Christmas, no less, is especially sick and sad to comtemplate.
I don't believe that this is what happened but I must say it explains all the clues and everyone's behavior from that night if it did.
Which leads me to another question in a timeline posted elsewhere. It said that JBR had an annual physical months before the murder and the doctor made an inspection of JBR's vaginal area. I've never had a daughter but is it common to inspect that on a six-year-old? If not, would it seem odd that the doctor would do so on JBR without some cause?
