It was a pretty good motion, I wish: 1) they had stressed that the right to a fair trial under the Sixth Amendment goes to the defendant; and 2) they had specifically cited cases, if any, where Rule 3.6 had been reduced to an order and applied to non-lawyers. They did raise this issue that Rule 3.6 is only applicable to lawyers, but if no court has ever expanded the rule to cover nonlawyers, then this should have been stated. I question whether Titus had the authority to give Rule 3.6 such an expansive reading.

Margaret, that's an excellent point about Rule 3.6. So Titus's order deviated from the norm. That's very troubling.

I have been very puzzled by the order. That's why I'd like to read it. LOL!

I still don't understand how this judge could invoke Rule 3.6 and apply it to nonlawyers, such as potential witnesses. If Titus wanted a gag order, why not just issue a gag order?

Little about this case makes sense.

Thank you. I've read it now. It's hard to see where 3.6 applies to non-lawyers. Is there any precedent or basis for a judge to order defendants or witnesses into silence?

The Judge will simply ignore this motion just like he has so many others.

There was a movie a while back that starred Cher, Dennis Quaid and the dad from "Frasier" where the judge was really hard on the defense and then it turned out the judge was the actual murderer. I don't know why that movie just came to mind....

Those Nifong quotes are rich! Did the local MSM shy away from posting the filing because some of the sources of Nifong's quotes are referenced to the N & O, WRAL, etc.?
