Attorneys in Duke rape case file motion to get lineup report

The woman who has accused three Duke University men's lacrosse players of raping her failed to identify at least one of them in a photo array eight days after the reported attack, according to a motion filed Friday by defense attorneys. The motion also says that she then selected him as an attacker more than two weeks later.

That case (once the woman was rescued) it was reported monotonely. No outrage. None of the seething hate that came through in the Cable shows discussing the LAX kids.
No one speculated that he planned on kidnapping a white women,
no one ascribed terrible motives to the man, etc.

ENTIRELY DIFFERENT

I don't know how much data they keep or for how long.

From personal experience - some friends were being investigated by the feds. Voice mail messages from over a year earlier were retrieved.

I heard a celluar phone expert interviewed for a different case and he did say voice mail is frequently lost. He said you can't wait to get that.

Agreed, vmail is a different animal. The actual message may be lost, but the call information which went to vmail should be available. That could be a reason the owner of the phone cancelled the service. There may have been vmail messages to the AV about appointments, client names etc that she had stored for future reference.

I wonder what chapter of the pimp reference manual describes how to handle lost or stolen cell phones?

I do not think the Defense has had access to the phone. I don't know when the (I'll take my sweet time) Judge will review the information.

I thought it was a bad call by the Judge to withhold that phone due to 3rd and 4th party privacy issues. This is a felony case, the only more serious crime in North Carolina is Murder. The rights of the parties in this case supercedes privacy issues. Loan your car to someone, if the driver is murdered or the driver murders someone - see how much concern the Judge gives you for your private papers in that vehicle.

I really don't like the fact the Nifong claimed he hadn't examined the phone. What is Nifong distancing himself from? Unless you were born this morning, you know a DA with his reputation on the line examined that phone (had someone examine it).

That comment by Nifong was the moment I stopped trusting him. That entire hearing was a joke.

100% agree.. That is one of if not the dumbest statements I've heard made during this case. And I've heard some dumb ones. For him to say he couldn't imagine how the contents of the phone would be evidence, not only insults our intelligence but proves he's an idiot..

What you say is extremely true. All of the Duke Lacrosse team must understand that if they don't toe the line, their behavior could impact the lives of the three who were picked to take it for the team. It is so hard to tell kids who for some strange reason believe they are invincible, that the rules of engagement have changed. What one might have been forgiven as youthful indiscretion in days gone by might now place you and all those you love in peril. Even a righteous expression of indignation today -- directed in just the wrong tone of voice -- can have ramifications beyond any hell you can imagine. An innocent gesture can destroy a life. Teach you children to be on guard -- it is not a benevolent world anymore. Teach children to trust in God, stand for what is right, make a conscious decision to never let the world dictate what they are and who they must become. We used to call it breeding. Now, I call it survival. I love children. I want them to survive -- not just mine -- but every little face I see as I drive by on my way to work, I pray for their safety and protection. I hope my drive-by prayers will keep from them what we as a family have suffered. Finally, you guys have done a great job while I was away yesterday. Focus on facts, not speculation. That's all that can help the three chosen sacrifices.

Did you guys catch the Duke sold the homes they owned on Buchanan and nearby streets but NOT the house at 610 Buchanan?

Wasn't one of the demands at one of the protests that the house be turned into a rape crisis center?

I think a moat and drawbridge would be much more advantageous.

Grand Inquisitor is more like it. Back then it was heresy they were looking for. Now, well let's just say deep pockets and a lapse of good judgment.

I have to say our children (those of Generation X and slightly older) don't have the "white guilt" our Baby Boomer generation has. The black community may just find out they spent the last of their moral authority. Parents of the Boomer generation wanted to reach out and right the wrongs of long dead ancestors in this country. Boomers really bought into the program, but I've noticed 30's and younger don't have that mentality. This may be the last payment on the debt owed to African Americans. It depends on how many people have to be destroyed and bankrupted before the white middle class says, "Enough!"

They thought the same. Unfortunately they did not. One of them is spending some time in Danbury, CT because of it.

Text messages, on the other hand, are not kept by the phone company. Cell phones store the last ten text messages. That is why the lawyer wanted the phone.
