The motion also says that she then selected him as an attacker more than two weeks later.

That case (once the woman was rescued) it was reported monotonely. No outrage. None of the seething hate that came through in the Cable shows discussing the LAX kids.
No one speculated that he planned on kidnapping a white women,
no one ascribed terrible motives to the man, etc.

From personal experience - some friends were being investigated by the feds. Voice mail messages from over a year earlier were retrieved.
Agreed, vmail is a different animal. The actual message may be lost, but the call information which went to vmail should be available. That could be a reason the owner of the phone cancelled the service. There may have been vmail messages to the AV about appointments, client names etc that she had stored for future reference.

I do not think the Defense has had access to the phone. I don't know when the (I'll take my sweet time) Judge will review the information.
I thought it was a bad call by the Judge to withhold that phone due to 3rd and 4th party privacy issues. This is a felony case, the only more serious crime in North Carolina is Murder. The rights of the parties in this case supercedes privacy issues. Loan your car to someone, if the driver is murdered or the driver murders someone - see how much concern the Judge gives you for your private papers in that vehicle.
I really don't like the fact the Nifong claimed he hadn't examined the phone. What is Nifong distancing himself from? Unless you were born this morning, you know a DA with his reputation on the line examined that phone (had someone examine it).

That comment by Nifong was the moment I stopped trusting him. That entire hearing was a joke.
100% agree.. That is one of if not the dumbest statements I've heard made during this case. And I've heard some dumb ones. For him to say he couldn't imagine how the contents of the phone would be evidence, not only insults our intelligence but proves he's an idiot..
No kidding! I thought they disappeared after a few weeks.
Wow. That really would be a treasure trove, which makes me suspect even more that someone made it go away.
Wasn't one of the demands at one of the protests that the house be turned into a rape crisis center?
I think a moat and drawbridge would be much more advantageous.

I have to say our children (those of Generation X and slightly older) don't have the "white guilt" our Baby Boomer generation has. The black community may just find out they spent the last of their moral authority. Parents of the Boomer generation wanted to reach out and right the wrongs of long dead ancestors in this country. Boomers really bought into the program, but I've noticed 30's and younger don't have that mentality. This may be the last payment on the debt owed to African Americans. It depends on how many people have to be destroyed and bankrupted before the white middle class says, "Enough!"

Text messages, on the other hand, are not kept by the phone company. Cell phones store the last ten text messages. That is why the lawyer wanted the phone.
