May 13, 2006 — The second round of DNA test results in the Duke University rape investigation show "no conclusive match'' to any lacrosse players, defense attorneys said, but a vaginal swab of the alleged rape victim produced DNA from a "single male source'' — a man not on the lacrosse team who did not attend a March 13 party that was the site of the alleged rape.

Defense attorney Joe Chesire declined to identify the mystery man or his connection to the alleged victim, but ABC News' Law and Justice Unit has learned that the unnamed source of the DNA is the alleged victim's "boyfriend," according to her mother.

ABC News is withholding the name of the man because he is apparently not a target of the investigation. Records indicate that Durham, N.C., police gave the "boyfriend'' a cheek swab to collect DNA on May 3, ABC News' Law and Justice Unit has learned exclusively.

It is unclear if or how the first DNA tests missed what appears to be the only foreign genetic material found on the alleged victim's body, defense attorneys said. Two Duke lacrosse players were indicted more than two weeks before the cheek swab was taken from the "boyfriend."

It is also unclear whether the alleged victim had sex with the "boyfriend" the night she claims to have been raped by three Duke lacrosse players. DNA experts tell ABC News that genetic traces of semen can remain in the body up to six days after intercouse.

CNN has added yet more confounding facts to this story. Assuming the police records are correct -- the cabbie's return trip observations take place AFTER Kim's 12:53 9-1-1 call, and AFTER the police went to the house and stayed for 11 minutes -- finding no one.

Mostafa said he got another call to pick up people at the North Buchanan address later in the morning of March 14, about 1:07 a.m.

He said he saw about 20 people on the lawn of the house, "yelling, talking back" to each other, including one black woman who he said didn't appear to be injured.

The woman, who seemed to be arguing with the young men, crossed in front of his taxi and got into an "old, white car," Mostafa said. He couldn't see if anyone else was in the car, he said.

"I heard her talking back to the guys" in what was apparently not a friendly conversation, he said.

The woman began to drive away in her car, but suddenly stopped and backed up, almost hitting his taxi, Mostafa said.

Four men got into his cab, and they appeared to be drunk, Mostafa said.

One of them said, "She's just a stripper," Mostafa said.

It seems impossible that Kim and the accuser remained any where near that house after 12:53. Still -- the cabbie saw the Black woman get into an old white car, when we know Kim was driving a black or very dark navy blue Honda. The cabbie wasn't drunk -- how could he mistake an old white car for Kim's newer black car?

Maybe the taxi driver is just wrong, but the search warrant clearly states that during the 12:55 check of the house, no one answered the door but parked in front of the house was a GREEN HONDA. That may well have been Kim's Honda.

If so, where was Kim?

There should be a universal gag order for all rape and sexual assault trials. The media should not be allowed to cover it at all until the trial is over. This horrible media storm discourages anyone from pressing charges. Your name, and your families names will all be posted on the internet. The accuser should be thought of as innocent until proven guilty in a court of law, not the court of public oppinion. This is all just really horrible. Some of these people on this thread have lost all objectivity and reason. They have gone off the deep end. Maybe they should take their meds. And you are welcome, I was happy to serve.

Hey, hootiebird: The idea that a DEFENDANT is innocent until proven guilty was tossed out the door when this idiot Ass-Clown District Attorney gave some 70 press interviews, leaking like a sieve. What about THEIR rights? Toss in the history of this skanky slut accuser "exotic dancer" call-girl (whore) escort, with her previous charges against three men from 10 years ago, her mental history, and the coincidental nearly identical case from Florida (where she probably got the idea to set these rich white boys up for a lawsuit) and what have you got?
