May 13, 2006 The second round of DNA test results in the Duke University rape investigation show "no conclusive match'' to any lacrosse players, defense attorneys said, but a vaginal swab of the alleged rape victim produced DNA from a "single male source'' a man not on the lacrosse team who did not attend a March 13 party that was the site of the alleged rape.
Joe Cheshire, a defense attorney for Duke University lacrosse players at the center of a rape investigation, said the latest tests show no conclusive match to any of the lacrosse players' DNA. (ABC News
Defense attorney Joe Chesire declined to identify the mystery man or his connection to the alleged victim, but ABC News' Law and Justice Unit has learned that the unnamed source of the DNA is the alleged victim's "boyfriend," according to her mother.
ABC News is withholding the name of the man because he is apparently not a target of the investigation. Records indicate that Durham, N.C., police gave the "boyfriend'' a cheek swab to collect DNA on May 3, ABC News' Law and Justice Unit has learned exclusively.
It is unclear if or how the first DNA tests missed what appears to be the only foreign genetic material found on the alleged victim's body, defense attorneys said. Two Duke lacrosse players were indicted more than two weeks before the cheek swab was taken from the "boyfriend."
It is also unclear whether the alleged victim had sex with the "boyfriend" the night she claims to have been raped by three Duke lacrosse players. DNA experts tell ABC News that genetic traces of semen can remain in the body up to six days after intercouse.

When these two showed up....it wasn't what they were told and Crystal was obviously in pretty lousy condition. Someone said "Oh, oh...and they started to take pictures.
This whole incident was one hour long. Look where we are!! Shame on our system!!
As long as she's got children, she'll probably get no more than community service or weekend incarceration and parole. It happens in the city near me all the time.
I think some judge will toss the ID before the trial. There are afterall federal courts when ones civil rights are being trampled on. The problem with that is it is also the logic of a local judge under pressure to let the federal courts decide.

I'd take that bet. I've never placed a wager in my life, as it seems like a waste of good money -- but I'd take that one.
It takes so little to indict and the judge can be VERY selctive in the info he gives the jury.
Kids take pictures constantly. The lacrosse players started taking pictures immediately - before it was apparent that she was very impaired. Their motivation at midnight versus 12:30am might have different however.
FIVE felonies reduced to misdemeaners only got her SIX days in jail. You and I would still be behind bars.

We have a similar but different situation.
I have a steppbrother who is about 40. My mom and his dad married long after I had married and had my first son, so we do not have the emotional bond he and my youngest sister have.
All in all he is a good guy, but stupid. I thought at first "Yeah, they all say they didn't do it."
Long story, short version. He is doing 5 years in VA State prison for date rape. He drove an employee home, they went to his house and had sex. He took her home the next morning. She was just about to graduate from Bridgewater College. They have very high standards for students and moral behavior. Her boyfriend was waiting for her in the parking lot.
He was arrested 1 year later. She must have claimed rape at the time, because they had DNA.
Some people have no common sense. One year later, the cops come calling. He made 2 mistakes...lied saying there was no penetration and chose his lawyer by their fees.
This was in Harrionsburg,VA. He was convicted .
There was no forensic protocol. The evidence was handled sloppily. She was tested and had evidence of "sinus medicine." Considering the type of sex they had and how long they had it, sounded like she might have had a little meth.
She claimed a date rape drug - nothing showed up. But they beolieved her because he gave her a glass of water.
But in spite of the date rape claim, she was able to describe the evenings sexual acrobats in detail.
Fortunately, he is in a prison that is considered safer than most in VA.
In the end they decided not to appeal as he would be out before the appeals ran their course and quite frankly, he could not afford it.
Moral of the story, never talk to the authorities until you have a lawyer and if you do talk, never, ever lie even if for no other reason than you are scared.
I seem to remember reading early-on that Kim was PO'd that the guys had taken pictures and VIDEO of their dancing.
There just MIGHT BE video.

Yeah, singing "Nobody knows the trouble I've seen..." :-) It's not about justice, my dears, it's about wins and losses for the D.A. and revenge for the disenfranchised.
I have a slightly different take on this. I find it hard to believe that a DA with over 20 years of experience didn't suspect that she was a prostitute. In fact, I believe he was confident that the DNA on her was from the lacrosse players because he assumed they had paid her for sex.
I remember when I first heard the defense lawyers say that no sex whatsoever occurred that night...I was stunned! I bet Nifong fell out of his chair when he heard that.
