DURHAM, N.C. -- A Duke lacrosse player whose DNA may match tissue found under the fake fingernails of an exotic dancer who claims she was raped was identified in a photo lineup with 90 percent certainty, sources tell NBC-17.
The Durham Herald-Sun reported Thursday tissue found under the accuser's acrylic fingernail came from the same genetic pool and was "consistent" with the bodily makeup of one of 46 lacrosse players who gave DNA samples for testing.
The paper cites several sources and said scientists also ruled out a possible match with any of the other 45 students, according to the sources.
If accurate, the fingernail tissue match would offer the first DNA evidence potentially linking the dancer and an alleged attacker.
But because a complete DNA pattern was not obtained from the tissue, it was not possible to match it with the nearly 100 percent certainty that DNA results usually offer, the sources added.
90 Percent Certainty
Now, NBC-17 has learned that the player is not one of the two already accused in the case -- Reade Seligmann, of Essex Fells, N.J., and Collin Finnerty, of Garden City, N.Y. He is, however, a player that the alleged rape victim picked out in a police lineup with 90 percent certainty.
The 27-year-old North Carolina Central University student told police she was beaten and raped by three lacrosse players while she performed at a March 13 team party. She said she clawed at the players in an effort to fight them off.
Never Applied?
Defense attorneys claim, however, that nothing about the reported possible DNA match means anything to the case if you look at the type of fingernails, where they were found, and if you look at a picture of the accuser's hand shortly after she arrived at the party.
According to defense attorneys, police found four stick-on acrylic fingernails in a trashcan at 610 Buchanan Street, the house where the party took place. The tissue connected to the possible DNA match was found under one of those fingernails.
But defense attorneys said the third player accused lived at the house and it is no surprise that trace amounts of his DNA could be found inside his own trashcan. They also said they don't believe the type of fingernails that were found -- the kind that are applied with an adhesive strip -- actually ripped off during an attack. They don't believe the fingernails were ever applied and they say they have pictures to prove it.
NBC-17 has seen a picture of the dancer's hand at the house when she performed her dance routine. It appears that long, fake fingernails were on some of her fingers in that photo, but not all of them.
Other photos show what defense lawyers believe is red fingernail polish on the walls of the house and on the railing outside the house. They believe the accuser was painting and applying her nails while at the party.
Defense attorneys admit that none of them have seen the DNA report the Herald Sun article is based upon, but they said if District Attorney Mike Nifong has the DNA report, their clients are entitled to see it.
Accuser's Father Responds
The accuser's father called reports of a DNA break in the case long overdue.
"I wasn't surprised to hear that. I feel like we should have learned it before," he said.
Kim Roberts, another dancer who performed at the party where the alleged attack took place, paid an emotional visit to the accuser's parents on Thursday.
"It was real emotional -- she was crying, my wife was crying. She said that she was sorry she left (outside) the house before my daughter did," the accuser's father said.
Authorities said they would know what the DNA shows by early next week.
" Not knowing her occupation, I believe the SANE nurse came to some wrong conclusions. "

I wonder how many cases of possible rape this SANE nurse examined and reported that the areas appeared normal and without any obvious signs of trauma ?
Assuming that there were no obvious signs of trauma- how much of her report was subjective ? Especially if the nurse believed that this person had been raped and sodomized by 20 men and possibly a broomstick.
Absent any obvious injuries, the terms " swelling " and
" redness " are very subjective in this anatomical area .
Infection, hormonal changes, STDs, etc can cause the same symptoms.
Nifong and the Lady Airheads describe the injuries as nearly life threatening- I'm surprised CM was able to walk or sit normally. Or to even breathe properly after the choke hold.
Should be interesting to see if there were GYN , proctology and ENT consults to deal with the injuries and what they observed .
Of course the false accuser was wearing a teddy. That might have been a clue about her occupation.
If these women love semen so much why don't they hang around merchant mariner bars?

Isn't it possible that she was raped before the party... by the boyfriend. Perhaps that's why she was so upset. She might have been upset enough to let it slip to the police that she had been raped, but then not have wanted to tell who. It would explain how distraught she was and why she kept changing her story. Just a theory though!
Have spent last two days catching up on what I've missed while in Durham (thanks for the pings). All I can say is, "Just. Wow." Do you think the "semen" or whatever is what Nifong was talking about when he said the defense was not telling the press everything that was in the first DNA report, perhaps?

Sort of. Nifong got the judge to issue a non-testimonial order which was described an as order to voluntarily give the sample or face court action to force you to. They gave the sample without officially being forced to.
Anyway, I take it to mean it is someone who is well known like a public official, or notorious crook. But I repeat myself.

I hate to be so bold...But redness and swelling indicates a looooong sexual encounter not 4-2 minute sessions...with a condoms besides...which are smoother than a babies butt.
No player had a moustache at least during the season. It was against team rules.
Out of 45 or 46 guys I'm sure at least one of them might have grown a moustache in the past.
That is why I suspect the DA got ahold of a lot of old photos of the team members to show the false accuser before she looked at the line-up pictures. If one of them had a moustache in the earlier photos that might be why she mentioned it.
It wouldn't be legal for the police or DA to do that but perhaps someone else did. Maybe the same person who ran the Dun & Bradstreet report to identify the players with the most money.

A most excellent find, Dukie07. Thank you for posting that here. Although there seem to be some people who want to condemn all Duke University students as overprivileged brats, that link tells an entirely different story for what I'm sure is the majority of students.
I just had a thought reading your post. I remembered something the ex-hubby said about her wanting to dance and he didn't fault her for feeding her children. Wonder if she is not the one who wanted her to dance but him and the night this all happened, she was wanting to back out/not dance. She goes to him (or is with him) to tell him she doesn't want to - again - he beats her and has sex with her to make her submissive. This could account for some of her weird behaviour.
Reade Seligmann's attorney filed a motion with the court to throw out the IDs. One of the things he included was a sworn statement from a player that the lacrosse players weren't allowed to have facial hair.
If I heard right, Joe Cheshire said last night that his client David Evans, widely believed to be Mustache Man, has never had a mustache.
