DURHAM, N.C. -- A Duke lacrosse player whose DNA may match tissue found under the fake fingernails of an exotic dancer who claims she was raped was identified in a photo lineup with 90 percent certainty, sources tell NBC-17.
The Durham Herald-Sun reported Thursday tissue found under the accuser's acrylic fingernail came from the same genetic pool and was "consistent" with the bodily makeup of one of 46 lacrosse players who gave DNA samples for testing.
The paper cites several sources and said scientists also ruled out a possible match with any of the other 45 students, according to the sources.
If accurate, the fingernail tissue match would offer the first DNA evidence potentially linking the dancer and an alleged attacker.
But because a complete DNA pattern was not obtained from the tissue, it was not possible to match it with the nearly 100 percent certainty that DNA results usually offer, the sources added.
90 Percent Certainty
Now, NBC-17 has learned that the player is not one of the two already accused in the case -- Reade Seligmann, of Essex Fells, N.J., and Collin Finnerty, of Garden City, N.Y. He is, however, a player that the alleged rape victim picked out in a police lineup with 90 percent certainty.
The 27-year-old North Carolina Central University student told police she was beaten and raped by three lacrosse players while she performed at a March 13 team party. She said she clawed at the players in an effort to fight them off.
Never Applied?
Defense attorneys claim, however, that nothing about the reported possible DNA match means anything to the case if you look at the type of fingernails, where they were found, and if you look at a picture of the accuser's hand shortly after she arrived at the party.
According to defense attorneys, police found four stick-on acrylic fingernails in a trashcan at 610 Buchanan Street, the house where the party took place. The tissue connected to the possible DNA match was found under one of those fingernails.
But defense attorneys said the third player accused lived at the house and it is no surprise that trace amounts of his DNA could be found inside his own trashcan. They also said they don't believe the type of fingernails that were found -- the kind that are applied with an adhesive strip -- actually ripped off during an attack. They don't believe the fingernails were ever applied and they say they have pictures to prove it.
NBC-17 has seen a picture of the dancer's hand at the house when she performed her dance routine. It appears that long, fake fingernails were on some of her fingers in that photo, but not all of them.
Other photos show what defense lawyers believe is red fingernail polish on the walls of the house and on the railing outside the house. They believe the accuser was painting and applying her nails while at the party.
Defense attorneys admit that none of them have seen the DNA report the Herald Sun article is based upon, but they said if District Attorney Mike Nifong has the DNA report, their clients are entitled to see it.
Accuser's Father Responds
The accuser's father called reports of a DNA break in the case long overdue.
"I wasn't surprised to hear that. I feel like we should have learned it before," he said.
Kim Roberts, another dancer who performed at the party where the alleged attack took place, paid an emotional visit to the accuser's parents on Thursday.
"It was real emotional -- she was crying, my wife was crying. She said that she was sorry she left (outside) the house before my daughter did," the accuser's father said.
Authorities said they would know what the DNA shows by early next week.

I have a problem with them taking the DNA of all 46 boys to start with just because it probably would produce say 6 matching markers to start with.
For instance, lying flat on the floor, then scooting into the bathroom and supposedly fixing her nails, smiling as she's leaving the back of the house, falling down the stairs (on one shoe, understandable), being helped into Kim's car, blotto in the car at Kroger's BUT holding tight to the gear shift, on the way to jail in the police car suddenly screaming that she's been raped, first by 20 white men, then 3, id'ing 4, etc. etc.
Can you find that riddle for us? I never saw it.
Well, I guess not. After all, it would mean they'd have to check their brains at the courthouse door just to level the playing field with a peabrain like Nifong.
I just read the article from the 2002 Raleigh News & Observer where the Durham Police Department was under investigation for some of their staffers operating (or involved in) a "call girl" operation. Is that one of the items you referred to?

I think her party behavior is just the latest episode in a long-standing pattern of mental instability and substance abuse.

I never posted at CTV, just read it.
I heard of the case very early on, when it broke nationally with the 46/47 DNA dragnet. I was outraged. I had no love for jocks or Duke either. The details Nifong dribbled out was very effective in the beginning without any defense countering. I was very convinced a rape occured, the boys did it, and the ones who didn't are immorally staying silent. Nifong's remarks that "DNA will exonerate the innocent and point to the guilty" was, well, "seared" into my brain.
Then I smelled something fishy when Nifong began to talk about the bogus 75-80% stat, recall he did this before 4/11. When the DNA results were back on 4/11 I was incensed because I knew then I had been had. The thing I hate the most is to be duped. I certainly would not give Nifong any more credence than he deserves.
Then the photos.
Then the illegal police invasion to circumvent legal consel.
Then the alibi.
Then the exposed refusal to look at the photos or the alibi.
Then asking NBC reporters for the photos.
No more. I decided then that Nifong was an out-of-control DA hogging the limelight and power and the paragon of the Peter Principle.
Then the Black Panthers.
And the hatred, blind hatred shown by the local residents and on internet.
Then the realization of how deep a cesspool Durham and the Durham justice system is.
The leaking,
The blackmail of an honest immigrant cab driver.
That is how I got here.
I agree; and it seems against their civil rights.
If the false accuser initially told police/Nifong that she had sex with her boyfriend, how could Nifong tell a judge that a non-testimonial court order compelling the entire team to provide DNA samples would definitely prove which players were innocent and which were guilty?
Nifong obviously believed the semen retrieved was that of the players, because she convinced him she had been with no one consensually.
Could someone tell me the status of the moustache? Is there any actual evidence that one of the players did or did not have a moustache?
You mean they have rehab centers for stupidity ? LOL. I sure hope not, that would prolong this mess. The players and their families need an end to this insanity. They need to kiss Duke g'bye and get on with their lives. I was appalled to hear that a trial would not take place until next spring.
Yes and if I understand correctly, she has not conceded.
