They stated, "Every year since 1989, in about 25 percent of the sexual assault cases referred to the FBI where results could be obtained, the primary suspect has been excluded by forensic DNA testing. Specifically, FBI officials report that out of roughly 10,000 sexual assault cases since 1989, about 2,000 tests have been inconclusive, about 2,000 tests have excluded the primary suspect, and about 6,000 have "matched" or included the primary suspect."

The authors continued, "these percentages have remained constant for 7 years, and the National Institute of Justice's informal survey of private laboratories reveals a strikingly similar 26 percent exclusion rate."

I get the joke, but it's a physiological and physical circumstance that a drunk man can refuse consent and there's not a damn thing the woman can do about it. The reverse is not true. And that's why we're having this discussion.

I did understand. Very well. No matter-- if both are drunk -- it is STILL the man's fault, according to law, should she complain. He, by the very nature of "law" cannot be "raped". And this is a problem we are having with bias in laws.

Let me throw another one at ya.. :)

Are pedophiles all the same? Nope. The common prception is that adult males pedophile only rape girls.

He's declared an evil criminal straight male. So. What happens when an adult male sodomizes a boy? Is he called an evil criminal homosexual male. Does that happen? Nope. Hardly ever. In fact, I started looking into this in the early 90s. I have yet to see in any case an adult male on boy sodomy referred to as an evil "homosexual" male.

Back to the first one. The very legal definition of "rape" involves the word "vagina". That's why he cannot be raped by a female. He can, however, be "sodomized". Ya ever hear of a female being charged with sodomy on a "male"? Nope. See case #2, above.

We know darn well there are *some* men out there who grab and feel every chance they get. They may even rape if they get the opportunity.

There are just as many women who'd cut you to the quick, at every opportunity, if they had the opportunity.

I've had far more abusive female bosses than male bosses; and overall I've had more male bosses.

Secondarily, I've found far more many honorable males than females. Men understand "reality" better than females do, IMHO. The world of "girls" is a cheap preparation for what the world of "boys" teaches boys and girls.

But then again, during the 90s, in doing research through FBI and statistical websites, we learned that it is usually the same males abusing females as it is the same males abusing other males.

Yes, I have come across the "type" you've described. Maybe it's the steel in my eye that holds them at bay. Or the fact when I "detect" a potential creep, I'm either out of there, or making sure he knows I've got him in my sights.

The phrase that some men make about "how he'll deal" with the guys dating his daughter one day -- is along the lines of "labor" boasting by women -- how many hours, who shredded worst, who birthed the biggest baby, who was the most "macho" of the birthing "thing". Men who say stuff as you've cited? It's an expression, backhanded, of how much they love their daughters.

Yes, if any of my daughters had been actually "raped" by a high profile person -- DAMNED STRAIGHT I'd report it, and that guy had better realize, we don't take things easy this way.

If my daughter, however, had put herself into a risky situation that she knew was risky, or if she was doing a "false" accusation... Well, my grown kids'll would have been able to tell you long ago: Don't try this with mom.

I have great girlfriends. And, I'm comfortable in the world of men and because I understand how they think. Therefore, it's been relatively easy for me to spot the "icky" ones.

I believe it was Cervantes who said: A lady may remain a lady, even amid an army.

This has been my experience as a truism.

The idiot DA is hinting that the defense alibi may not be valid because they do not know what HIS timetable is. One must assume that he may be trying to say that the alleged rape occurred prior to accused defendant Seligman's departure. My only reaction was "So why is the accuser smiling as she is leaving?"

I have no idea what he means. His own witness, the neighbor, as well as the photos show she arrived at 11:50 or later. so, how different could his time line be?

I know he is leaking that the photos are forged, and if they are, that puts a whole new light on things but seems virtually impossible. The photos come from different cameras/camera phones, match the cell phone records (unimpeachable) and atm phots (unimpeachable) and cab driver recollections. So, what is he talking about.

it don't think it's really a joke: the issue that is being discussed concerns the legal issue of consent. if a woman is drunk, and verbally consents to have sex with a man, is she really giving consent? suppose she is also responding sexually in a physiological way.
it is a real murky area of law, because the man could be drunk too, the man could have gotten her drunk on purpose to get her to have sex, etc.
now reverse the roles: suppose the guy is really prudish, and the woman gets him drunk enough to want to have sex but not so drunk that he can't respond. is he legally consenting? is it rape/sexual assault?
these issues actually get played out in court.

Freda Black Concedes In Durham County DA Race

DURHAM, N.C. -- The former prosecutor who challenged the district attorney handling the investigation into rape allegations against members of the Duke men's lacrosse team conceded the election Friday, three days after a close loss.

"Now is the time for us to rally behind the candidate whom the people of Durham have selected," Freda Black said in a prepared statement issued by e-mail. "We will pray that Providence will guide Mr. Nifong in his decisions over the next four years."

Nifong won 45 percent of the vote in Tuesday's Democratic primary, with Black close behind with about 42 percent and Keith Bishop tallying 13 percent, according to complete but unofficial results.

There are no Republicans running in the general election, and Nifong only needed 40 percent plus one vote to avoid a primary runoff.

Nifong, 55, has been at the center of the investigation of allegations made by a black 27-year-old student at North Carolina Central University, who told police she was raped and beaten by three white men at a March 13 party thrown by members of Duke's lacrosse team.

Last month, a grand jury indicted Duke sophomore lacrosse players Reade Seligmann of Essex Fells, N.J., and Collin Finnerty of Garden City, N.Y., on charges of rape, kidnapping and sexual assault. Nifong has said he hopes to charge a third person. Defense attorneys have strongly proclaimed the players' innocence.

Nifong initially talked openly about his investigation, at one point labeling some players "hooligans" and boldly predicting DNA test results would identify the culprits.

Those tests failed to find a match between the accuser and any player tested, according to defense attorneys. And his early comments drew fire from Black, 45, and Bishop, 43, a lawyer in private practice.

Black, now in private practice, is a former colleague of Nifong's in the Durham prosecutor's office. Nifong demanded her resignation on the day he took over the district attorney's office last year.

She criticized him during the campaign for speaking too openly about the case.

"I believe a case should not be tried in the news media, that a case should be tried - any case should be tried - in a court of law," she said last month. "That would be after all the facts are gathered, all the evidence is in ... and the jury reaches a verdict."

Nifong eventually stopped communicating regularly about the case.

Black refused initially to concede the race and her campaign spokesman Brad Dixon said Black spent Wednesday with her family. The campaign scheduled a news conference for Thursday and then pushed it back to Tuesday before issuing the concession Friday.

Black did not attack Nifong in her statement Friday, saying that she had called to congratulate him before announcing that she was abandoning the race.

"I can tell you that my life will never be the same," Black said. "I will never forget the way you opened up your homes to me, the way you sacrificed for our campaign and the way you worked so hard for this cause that we all believed in. That has left a deep impression on me."
