Duke Rape Case Defense: Throw Out DA Nifong and Photo ID

Accused Duke lacrosse player Reade Seligmann's attorneys want Durham County District Attorney Mike Nifong thrown off the case.

Today, they filed a legal motion specifically asking for it.

"DA Mike Nifong neglected his duty as a prosecutor to seek the truth and a fair prosecution," the defense's motion reads.

The motions were filed just 24 hours before Nifong's Tuesday election in which he's fighting to keep his seat. Nifong is being challenged by former prosecutor Freda Black and private lawyer Keith Bishop

She was ahead until late. The voter turnout was higher than expected in key Durham precincts. Those precincts were under polled due to their turnout history.

All in all the result is typical of Durham politics. BTW, Jackie Wagstaff lost her bid for for reelection to the Durham County School Board. That is a blessing to the parents and children in Durham County. Nifong will be their curse....

Jesse Jackson got involved at the beginning. He went down there offered the girl a scholarship to college so she wouldn't have to use her body for money.

Said he'd give her the money even if it turns out she wasn't raped.

If I am not mistaken, Penn State is one of the few universities where the students and the town are one.

I agree that Duke exists in isolation from Durham. I was a student or instructor at Duke for 11 years. From 1987 to 1998, I lived right off campus in the grad student slums. Dukies went to Chapel Hill for a night out, or partied on campus. They (and I) were generally afraid to wander east of Markham.

That is DEFINITELY not true at other universities I have been affiliated with. At Clemson the University and the town are one. The same at Chapel Hill, Athens, even N.C. State to some extent. Georgia Tech in Atlanta has more ties to the community than Duke. Duke is an extreme example of the ivory tower. Nothing about how Duke handled this case surprises me. They have always been willfully blind tot he hijinks that happen on campus until something makes the University look bad. That is the only time they will act.

Duke could have handled this well. They could have said from the outset that the suspension of the season was for the admitted stripper party. Instead they left the definite impression the suspension was the result of an as-of-yet unproven allegation of rape. The fact is, they probably would have done nothing had they found out about the stripper party through other channels. They only acted because it was in the press. Shoot, worse things happen in Krysiewskiville while students are waiting for basketball tickets. As long as there are no reporters there, no harm no foul.

Typical Duke.

I found this very enlightening. I was at a loss as to how Nifong could get elected. Forgive me if this has been posted before, but it's worth a listen imo.

I believe it was William James who said that it takes only one white crow to prove that not all crows are black. This case has provided us with the white crow, has it not?

I'm sure the lacrosse players' parents thought their sons would have no contact with the community either.

After Nifong used his victory interview with Greta to once again mention he had fired Freda after his appointment, I doubt Black feels any need to publicly congratulate him.
