Accused Duke lacrosse player Reade Seligmann's attorneys want Durham County District Attorney Mike Nifong thrown off the case.
Today, they filed a legal motion specifically asking for it.
"DA Mike Nifong neglected his duty as a prosecutor to seek the truth and a fair prosecution," the defense's motion reads.
The motions were filed just 24 hours before Nifong's Tuesday election in which he's fighting to keep his seat. Nifong is being challenged by former prosecutor Freda Black and private lawyer Keith Bishop
Nancy Grace saying they're Guilty again.

You're right. Kim G and another lady were on Hannity and Colmes tonight....same thing. When Sean gave evidence of Seligmann's alibi...phone calls, ATM, etc., Kim said that he could have raped her in two minutes, or when he was on the phone. Then both women said that the accuser could have had the times wrong........

Did it in 2 minutes in a tiny Bathroom (4 people in there), they put on Jackets first (to prevent scratching and DNA under her nails), it went undetected by the other stripper, and they managed to leave no hair, skin cell, salvia, semen, sweat, and then left composed - and she left with a smile on her face!!

One good thing about a trial is that all those "He could have ..." improbable scenarios will be proven impossible.
Not if the Jury ignores it. One side puts up experts that says it couldn't have happened. Nifong will put up an expert that is asked well, it is theoretically possible an ATM time code can be off?
A rape expert will say that rapes have occurred in 30-45 seconds. The Rape "experts" will say that it's possible the woman was afraid to so emotion in the face of her attackers - the smile was to deny her assailants from getting satisfication from her pain.
The JURY will not take from the testimony what you or I would.
The term Jury Nullification is used in regard to NOT convicting, but the same principles applies to conviction.
Juries routinely disregard the instructions from the Judge when weighing evidence - it is common.
I thought Hardin was appointed to some sort of special judgeship that places him hearing cases across the state. I don't think he was appointed to Durham County specifically.

You're absolutely correct. Imagine Nancy Grace, Kimberly Guilfoyle, Wendy Murphy....and the like, on the jury. These boys would not have a chance.

I also noticed that the top of Kim's car has light gray, peeling paint that looks almost white. If she has a lot of that on the hood as well, the cabbie could have easily remembered it generally as white. It probably was of no importance to him at the time, and not the sort of thing one would remember well - not like one would remember who they picked up, what was said, where they went, and so on.
I think Nifong would have won by a larger margin but for this case.

Which Statement below is true. They seem incongruous. The media "pinned" the reporting of the previous gang-rape on her boyfriend. But, now they have a conundrum. The Media will say now they believe her Husband did plan to kill her in the woods. but this is at odds with their previous reporting. They said he held nothing against her for her extramarital affair in the Navy (when she got pregnant) and that he was thankful to her because she taught him to read.

Kenneth McNeil, her former husband, said in an interview 4/28 that three years after the incident, he URGED her to make the report to Creedmoor police to HELP HER OVERCOME HER TRAUMA.
I hope Black calls for a recount.
Hopefully all the middle and upper middle-class whites will gradually leave Durham, and the blacks can have it. We know what a $hithole they'll turn it into - give it five years.
Well, it looks to me like Shabazz and his boys were all Nifong could get. Jesse never made it down there, as far as I know, and neither did Dumbton. Mangum's family wasn't enthused to have them there, so who does that leave as far as encouragement goes? Quo bono? Nifong.
