Duke Rape Case Defense: Throw Out DA Nifong and Photo ID
ABC ^ | May 1, 2006 | CHRIS CUOMO, ERIC AVRAM, and LARA SETRAKIAN

Accused Duke lacrosse player Reade Seligmann's attorneys want Durham County District Attorney Mike Nifong thrown off the case.

Today, they filed a legal motion specifically asking for it.

"DA Mike Nifong neglected his duty as a prosecutor to seek the truth and a fair prosecution," the defense's motion reads.

The motions were filed just 24 hours before Nifong's Tuesday election in which he's fighting to keep his seat. Nifong is being challenged by former prosecutor Freda Black and private lawyer Keith Bishop

Brit Hume just reported that the father of the stripper says that she wishes she had never brought the charges and that Nifong called the father last week to ask that he encourage his daughter to remain strong (paraphrase).

Says Duke officials abandoned team
The player says Duke University officials turned their backs on the team.
"From the get-go, we've only had each other to fall back on," he said. "We've been convicted in the media. Our university turned its back on us...They didn't stand up for us, and we feel neglected and that our loyalty wasn't reciprocated."

He said the allegations have brought players closer together.

"We've stayed strong for this, and we still have each other. We'll be best friends for life," he said.

Coach 'was forced out'
The team was on its way to the national championship when the rape investigation began and Coach Mike Pressler resigned.
"He didn't resign. He was forced out," the player said. "The notion that he quit or resigned is ridiculous."

The player talked about the ad-hoc committee's report, released Monday, that detailed issues with the team's culture.

"As the report shows, there was a clearly a disconnect between student affairs and the athletic department and [Pressler] took the fall for a lot of things he didn't know about. All the incidents he knew about, he dealt with."

I hope the Duke Alum are paying close attention to how these boys and the coach were tossed out on their asses.

Politics aside, Nifong has an agenda and this mess presented an opportunity he latched onto.

There is something about Nifong we do not know about...a slight? a grudge?
Who knows. I can't prove it--it is only a gut feeling.

Oh brother. Nifong is real piece of work.
How is this man even in a close race for election?
Freda Black should be wiping his rearend.
What's wrong with Durham?

I guess they want a lynching as much as Nifong.

Thanks for posting.
I feel such sadness for these guys.
Helpless really, because there isn't anything I can do.

It is as if I am watching some bad joke play out, and nobody is doing anything about it.

I am glad to hear that the more people attacked them, the closer they became.
I guess Nifong will be smarting when he reads that.
So much for his pressure tactics to get an informant.

These are not bad kids, they could be the sons of any one of us.

I wonder what is in Nifong's closet?

I bet there is quite a bit in Nifong's closet. Has he been married before? I read somewhere this point mentioned along with a grown daughter. Maybe some girl dumped him for a lacrosse player or a lacrosse player dumped his daughter because he sure seems to have it in for them.

Yes, he has been married before. I cannot remember where I saw it, but it was a bio.

This jumped out at me, (always looking for a motive). :)

The team was on its way to the national championship when the rape investigation began and Coach Mike Pressler resigned.

From your WRAL link

On March 13, police say two dancers showed up at 610 North Buchanan Blvd. just before midnight. An hour later, at 12:53 a.m., police got a call from a woman who says she was passing by the house. "Hi, I don't know if this is emergency or not necessarily, but I'm in Durham driving down near Duke's campus," the caller said. Seconds into the call, the woman said she wasn't driving. "It's right in front of 610 Buchanan St. and I saw them all come out like a big frat house and me and my black girlfriend were walking by and they called us n--------," the caller said.

Jezebelle, Five years ago there was a poster named quidam who would post riddles. Although controversial, he was actually quite smart. There was some speculation it was William Safire or George Will. There was other negative speculation about him.

I remember quidam. Yes, he was quite controversial. My fondest/scariest memory of him was when he posted that Hillary Clinton was considering moving to New York and would enter the Senate race there. Stirred up quite a few posters saying he was crazy and didn't know what he was talking about. Oh well. We know better now! :)
