Accused Duke lacrosse player Reade Seligmann's attorneys want Durham County District Attorney Mike Nifong thrown off the case.
Today, they filed a legal motion specifically asking for it.
"DA Mike Nifong neglected his duty as a prosecutor to seek the truth and a fair prosecution," the defense's motion reads.
The motions were filed just 24 hours before Nifong's Tuesday election in which he's fighting to keep his seat. Nifong is being challenged by former prosecutor Freda Black and private lawyer Keith Bishop
I'm just sick!
I think I heard that the 2nd place person can call a runoff, but I'm not sure with that percentage.
Yeah, sometimes the bad guy wins.
Oh no! I thought Freda Black was ahead.
Sick Sad World!!!! :o
I heard it was 40 percent, plus one vote, but I did hear that the runnerup could call for a runoff the end of May.
Makes no difference. They've got a good shot at disbarring him, IMO...
What are they thinking?
He's power mad now.
No way he will drop this case if he wins.
sh!t
Dunno, Howlin. His tatic worked; he got re-elected. Now he can drop the case and make it go away. He's still DA...
I hope you're wrong and now that he has what he wants, he'll drop this loser rather than subjecting himself to a humiliating defeat in the courtroom.
I've always told my husband that if I was charged with something I didn't do, I'd ask for trial by judge. If it was something I did do, I'd go with a jury.
Radio Tapes Released From Night Of Alleged Duke Rape
UPDATED: 8:14 pm EDT April 26, 2006
Authorities have released tapes of police radio transmissions from the night a North Carolina Central student says she was raped by three members of the Duke lacrosse team.
The audio recording is of a conversation between a Durham police officer and police dispatcher the beginning at 12:58 a.m. March 14.
The black woman, a 27-year-old stripper and college student, told police she was raped and beaten by three white men around midnight at an off-campus party thrown by Duke's lacrosse team.
The audio recording begins when an officer responds to the scene of the party, a house on Buchanan Street. The officer tells the dispatcher that the alleged victim had apparently already left the scene.
The recording resumes when the same officer responds to another 911 call from a Kroger grocery store security guard at about 1:30 a.m. The guard called to report a woman in the parking lot who would not get out of someone else's car.
The officer can then be heard giving the dispatcher the police code for an intoxicated person. When asked whether the woman needed medical help, the officer said, "She's breathing and appears to be fine. She's not in distress. She's just passed-out drunk."
Duke lacrosse players Collin Finnerty and Reade Seligmann, both 20, currently face charges of rape and kidnapping in the case. District Attorney Mike Nifong and investigators believe Finnerty, Seligmann and one other unnamed player raped the woman.

12:58:52 AM "Sent two of the unites out and we'll do a little KNOCK and talk and see who's home."
****This tape is pieced together. This is a second call, maybe not by the same officers.
1:33:55 AM 12:33:55 AM She -- shes breathing apparently fine, shes not in distress, shes just passed out drunk
2:12:08 AM "...and see if you can't get somebody close to Charles Street to go by there and check on them younguns."
2:33:55 AM "...she's breathing and appears to be fine..."
2:37:07 AM "She's on here way to Duke now... "...get a SANE nurse and start the report and I'll let you know where we are at that point."
2:39:03 AM ..." the one that we talked to at the Kroger knew her? (Second voice) Quite possibly... (And I think he says "They worked together, but I"m not positive.)
That's exactly what I said!
I can hear all the commentators now on tv, "The voters of Durham believe in Nifong's case."
PUKE
I just cannot understand it.
Then again...this is a DEMOCRATIC primary for the DA.
The Dim's stupity never stops amazing me.
I bet the NAACP and the Black Panthers were busing people in.
If he wins, and it sounds like he has, life just got worse for the players. It shouldn't work that way, given what we know, but he's got a vendetta going and nothing will stop him now.
Unless it's true he shared info with the Black Panthers. I doubt he did, but if what they claim is true, I think he could be disbarred. You'd know better than me.
damn it....there will be no stopping him now...
NG's got a second wind with Nifong's reelection. She'll be wound up for a week or so...
