Duke Rape Case Defense: Throw Out DA Nifong and Photo ID

Accused Duke lacrosse player Reade Seligmann's attorneys want Durham County District Attorney Mike Nifong thrown off the case.

Today, they filed a legal motion specifically asking for it.

"DA Mike Nifong neglected his duty as a prosecutor to seek the truth and a fair prosecution," the defense's motion reads.

The motions were filed just 24 hours before Nifong's Tuesday election in which he's fighting to keep his seat. Nifong is being challenged by former prosecutor Freda Black and private lawyer Keith Bishop

I think I heard that the 2nd place person can call a runoff, but I'm not sure with that percentage.

I heard it was 40 percent, plus one vote, but I did hear that the runnerup could call for a runoff the end of May.

I've always told my husband that if I was charged with something I didn't do, I'd ask for trial by judge. If it was something I did do, I'd go with a jury.

I know, but the last think the man needs is to be put in a position of power for a long period of time . Lets face it, if the people pf Durham did not vote him out after this debacle...he can pretty much do anything.
AND HE KNOWS IT.

To me this vote makes him even more dangerous.
Now I know this was historically low turnout and Republicans could not vote, but still.

Radio Tapes Released From Night Of Alleged Duke Rape

Authorities have released tapes of police radio transmissions from the night a North Carolina Central student says she was raped by three members of the Duke lacrosse team.

The audio recording is of a conversation between a Durham police officer and police dispatcher the beginning at 12:58 a.m. March 14.

The black woman, a 27-year-old stripper and college student, told police she was raped and beaten by three white men around midnight at an off-campus party thrown by Duke's lacrosse team.

The audio recording begins when an officer responds to the scene of the party, a house on Buchanan Street. The officer tells the dispatcher that the alleged victim had apparently already left the scene.

The recording resumes when the same officer responds to another 911 call from a Kroger grocery store security guard at about 1:30 a.m. The guard called to report a woman in the parking lot who would not get out of someone else's car.

The officer can then be heard giving the dispatcher the police code for an intoxicated person. When asked whether the woman needed medical help, the officer said, "She's breathing and appears to be fine. She's not in distress. She's just passed-out drunk."

Duke lacrosse players Collin Finnerty and Reade Seligmann, both 20, currently face charges of rape and kidnapping in the case. District Attorney Mike Nifong and investigators believe Finnerty, Seligmann and one other unnamed player raped the woman.

If he wins, and it sounds like he has, life just got worse for the players. It shouldn't work that way, given what we know, but he's got a vendetta going and nothing will stop him now.

Unless it's true he shared info with the Black Panthers. I doubt he did, but if what they claim is true, I think he could be disbarred. You'd know better than me.
