Duke Rape Case Defense: Throw Out DA Nifong and Photo ID

Accused Duke lacrosse player Reade Seligmann's attorneys want Durham County District Attorney Mike Nifong thrown off the case.

Today, they filed a legal motion specifically asking for it.

"DA Mike Nifong neglected his duty as a prosecutor to seek the truth and a fair prosecution," the defense's motion reads.

The motions were filed just 24 hours before Nifong's Tuesday election in which he's fighting to keep his seat. Nifong is being challenged by former prosecutor Freda Black and private lawyer Keith Bishop

Isn't Scuse Me the one who said she was a kind, gentle person who didn't have a drinking problem?

Maybe this explains why some people in her life like her ex-husband have been saying nice things about her. Maybe they know if they say anything bad about her or to her they will be accused of rape or attempted murder?

Who else was at the party?

Apparently there was one (at least) black lacrosse player at the party. His DNA wasn't taken because the woman said her attackers were white.

In 2004 she filed a complaint with the Durham County Sheriff's Office against a nursing home where she worked briefly. As is her pattern, she dropped the complaint when the nursing home asked that she submit a criminal record in order to get paid. I bet she lied to the employer when hired, saying she had no prior arrests.

The mother said the accuser went to a Raleigh hospital last year "for about a week" with a "nervous breakdown". And as evidence of how close-knit the family is, the mother is guessing the problem was "mounting bills".

Court documents and her criminal and driving records show that her driver's license had been revoked before the incident, but they do not indicate why.

She's been in trouble with the law almost every year since she graduated from high school.

Taking it as a whole, you could say she's been in trouble with "authorities" for quite a few years.

Yes, she is troubled to say the least.

I cannot believe Nifong arrogant comments today, about how the defense doesn't want to go up against him.

According to Rita Cosby's initial interview with the ex-husband, at one time he and the accuser had restraining orders out on each other. I guess hers cited his attempt/threat to kill her, but I wonder what reason 'Scuse Me gave for needing distance from her?

Yeah, but what's he going to say on the witness stand when he's asked if he attempted to kill his ex-wife?

Could he be charged with a attempted murder if he answers "yes"?

Otherwise, he's got no choice but to say the woman is crazy.

That may be the purpose that police and prosecutors have acquired over the years, but that is not the purpose they are supposed to have under our constitution and legal system. That distorted purpose is another example of abuse of power by government.

Accusations of rape. (2)

Accusations of attempted murder.

Restraining orders.

Complaint about not being paid.

Alluding police.

High speed case, lights out, driving on wrong side of road, etc..

.19 point Breathalizer.

Theft of car keys.

Attack on a police officer.

Court ordered child support (must have been on aid before that).

At least one stay in a psych ward.

I'm sure I left out something.

I agree. I was just explaining the intital impulse of those close to her not to make her an enemy. He did not even mention the attempted murder allegation. Now that this is out in the open, he has to say she lied, if he is called to testify. However, he still might downplay it or refuse to comment to media about it.

Among the initial 2002 charges was "driving with a revoked license," so she had some driving infractions prior to the "joyride".

I somehow doubt the escort service provides W-2s to its employees. She may have committed tax evasion offenses.
