Lacrosse players face old charges (Nifong retaliates against Duke Lax)

DURHAM - District Attorney Mike Nifong plans to reinstate misdemeanor charges against a half-dozen Duke lacrosse players, saying a March 13 party where a woman reported a rape broke the deals that the players made with prosecutors.

Nifong's decision could affect players who, before the party, had entered agreements in which prosecutors would dismiss the cases if the players performed community service and stayed out of trouble for six months or a year. Among the first to have his charges reinstated was David Evans, one of the team captains who lived at 610 N. Buchanan Blvd., the site of the party in which lacrosse players hired two women from escort services to dance. One of the women told police that she was raped by three men in a bathroom.

Two players, Collin Finnerty, 19, and Reade William Seligmann, 20, were charged last week with first-degree rape, first-degree sex offense and first-degree kidnapping. Their attorneys say the men are innocent.

On Monday, an attorney for Seligmann filed a motion seeking information that would help attack the credibility of the woman, the only person, according to the defense filing, who says a rape occurred. The motion seeks information about the woman, including criminal charges, mental and emotional problems the woman has suffered as well as social services, probation, child protective services and victim's advocacy records.

Today, Finnerty is due in a Washington court where prosecutors in an assault charge are considering whether to revoke a deferred prosecution agreement similar to those affecting other players in Durham.

According to court records, 16 players were charged in the past three years with misdemeanor charges in Durham including noise violations, public urination and alcohol violations. The deals placed the men on probation for either six months or a year.

I kinda understand why OakOak left us because it was our loss, and I hope that's who rejoined as hugs and kisses... OO had a lot of inside info...

when you've been around as long as I have you learn to have very thick skin...

but back to the case...

correct me if I'm wrong, but didn't the AV get candy from the store for her kids before she went "to work"? and weren't the kids at daddy's house? I know the MSM has refused to identify him but someone earlier published some personal info that was deleted by the mods...

hmmmmmm......

You can be certain the defense team will bring it up...they can list all her stories and ask her just which one is correct?....this is never going to trial...

I read that one with the misleading headline a few days back. Maybe I am missing it, but I sure did not see any of these potential Duke students discussed in the article as "Lacrosse prospects" as the headline promises.

And naturally with the season trashed and no coach, I am not surprised. I would be pretty shocked if a top lacrosse prospect enrolls in Duke in August.

Yes, the father said she went to the store that evening to get candy and soda for the kids - but he didn't say what time that evening.

And we have detective Rod Wheeler on O'Reilly saying the Durham PD knows where she was before going to the Buchanan house and that she was intoxicated.

So maybe she did go to the store, but that was much earlier, maybe even before the kids' bedtimes, and doesn't shed any light on where she was during the 2-3 hrs. before the lacrosse players' party.

On Greta: All the panelists, including Ted Williams, criticizing Nifong's handling of the case. Saw a brief video of Nifong. Did anyone notice his right eye twitching? I don't recall him having that at the Charlotte community meeting a couple of weeks ago.

Ted tries to blame defense for trying the case in public. Gets rebutted by other panelists.

Gretta interviewed Duke coed friend of Collin Finnerty. She was very well spoken, and gave a strong endorsement of him. Said he is a gentleman.

Ideas, primal ideas, are not "logical". Logic -- such as the logic of naked snake in the Garden of Eden -- can work to obscure or pervert the idea, the ideals.

Yes at times I'd expect that my replies may seem disjoint, strange or confusing to the average reader. They are not, but in order to shoot my quiver of ideas into your mind, I apply that "supercharging" edge to them.

Now I am not trying to harm you at all -- I'm just using a analogy. I'm hoping you'll (1) learn to catch, barehanded, the arrows as they fly with shao-lin-like speed, and (2) learn to shoot back with the ideas G-d has blessed you with, with ideas that have an "edge" and are in motion.

He didn't even give her full address. Perhaps this wasn't the first time the police checked on CM's "younguns."

Otherwise there are more transmissions which haven't been released.

So my question is, if this ever gets to court, can the purported rape victim be forced to account for her changing stories? In other words, are the earlier tales she's told admissible for comparison with her testimony on the stand?

Yes which is why one of the things the defense demanded from the prosecutor the other day in the filing was every statement she has made to Durham authorities including how confident her ID was and how many chances did she have to have to make an ID.

And really they should not have had to ask. Prosecutors have a legal obligation to give exculpitory evidence to the defense.
