Mae Magouirk…not comatose …not vegetative …not terminal

Why is Hospice LaGrange, Ga. withholding nourishment?

(LaGrange, Georgia) Mae Magouirk is being withheld nourishment and fluids and the provisions of her Living Will are not being honored at the Hospice-LaGrange, (1510 Vernon Street, LaGrange “Troup County” Georgia, 706-845-3905) a subsidiary of the LaGrange Hospital in LaGrange Georgia. Her family is desperately seeking to save her life before she dies of malnourishment and dehydration.

Mae Magouirk IS NOT comatose and she IS NOT vegetative. She is not terminal!

Despite these facts the Hospice and Beth Gaddy, a school teacher at LaGrange’s Calloway Middle School and granddaughter of Mae Magouirk have been denying her proactive nourishment or fluids (via a nose administered feeding tube or fluids via an IV) since March 28 without prior legal consent; against the wishes of her Living Will and against the wishes of Mae Magouirk’s closest living next of kin. Mae Magouirk’s next of kin are: Mr. A. B. McLeod (Her Brother) and Mrs. Lonnie Ruth Mullinax (Her sister) both of nearby Anniston, Alabama.

Under Georgia law, unless a medical durable power of attorney is in place, your closest living next of kin are stipulated to make all medical decisions. When Mae Magouirk’s closest living next of kin lodged a complaint with Hospice LaGrange’s in-house attorney Carol Todd last Thursday, March 31, Ms. Todd checked Mae Magouirk’s case file and upon examination of both documents discovered that Beth Gaddy DID NOT have the durable medical power of attorney for Mae Magouirk and upon closer examination of Mae Magouirk’s Living Will ascertained that fluids and nourishment were ONLY TO BE WITHHELD if she was either comatose or vegetative. SHE IS IN NEITHER STATE!!!

Nor is Mae Magouirk terminally ill. Her local LaGrange, Ga. cardiologist, Dr. James Brennan and Dr. Raed Aqel, a highly acclaimed interventional cardiologist at the nationally renowned University of Alabama-Birmingham Medical Center have determined that Mae Magouirk’s aortic dissection is contained and not presently life threatening.

Two weeks ago, Mae Magouirk’s aorta had a dissection and she was hospitalized in the LaGrange Hospital in LaGrange, Ga. Her aortic problem was at first determined to be severe and she was admitted in the intensive care Unit. Her granddaughter, Beth Gaddy, a teacher at the Calloway Middle School in LaGrange, stated that she held Mae Magouirk’s medical power of attorney and thus invoked said powers against the wishes of Mae Magouirk’s closest living next of kin by having her moved to Hospice-LaGrange. While at Hospice-LaGrange, Beth Gaddy stated that her wishes were for no nourishment for Mae Magouirk via a feeding tube or fluids via an IV. Before hospitalization Mae was lucid and never had been diagnosed with dementia as was testified to in Probate Court on Monday, April 4, by a local MD.

Page Two Mae Magouirk is being starved to death!

Upon learning from Hospice-LaGrange that Mae Magouirk was being denied nourishment and fluids and upon being told by Carol Todd (Hospice LaGrange’s in-house legal consul) that Beth Gaddy DID NOT HAVE THE PROPER LEGAL AUTHORITY to deny said nourishment AND that the denial of nourishment went against Mae Magouirk’s Living Will, Mae’s family (Mullinax/McLeod) ordered the immediate beginning of such nourishment/fluids for Mae to Hospice via Carol Todd.

First Contact with Hospice on Thursday, March 31 Carol Todd told Mrs. Lonnie Ruth Mullinax (Mae Magouirk’s sister) and Kenneth Mullinax (Mae Magouirk’s nephew) via phone on Thursday, March 31 that Georgia Law stipulated that Mrs. Mullinax and her brother A. B. McLeod (Mae Magouirk’s brother) were entitled to make any and all decisions for Mae Magouirk. Mrs. Mullinax immediately told Carol Todd to insert fluids via an IV and insert a feeding tube, via her nose. Carol Todd had the IV fluids started that evening but told the family that they would have to come to Hospice LaGrange to sign papers to have the feeding tube inserted and because of such, she believed that Mae Magouirk would no longer be a candidate for Hospice LaGrange. She was then told that Mae Magouirk’s family concurred and the ONLY REASON Mae was at Hospice was because the LaGrange Hospital had failed to exercise due diligence in closely examining the power of attorney which Beth Gaddy said she had, as well as executing the provisions of Mae’s Living Will to her preordained stipulations. Gaddy only had a financial power of attorney and did not have a medical power of attorney and Mae Magouirk’s Living Will provided that a feeding tube and fluids SHOULD ONLY BE DISSCONTINUED IF Mae was comatose or in a vegetative state. She was and is in neither state.

Attempt to rescue Mae on Friday denied by Probate Judge Donald Boyd On Friday, April 1, when A. B. McLeod (brother) and Kenneth Mullinax (nephew) showed up to meet with Carol Todd and to arrange emergency air transport of Mae Magouirk to the University of Alabama-Birmingham Medical Center (One of the top cardiovascular centers in the USA) Hospice LaGrange stalled them while Beth Gaddy went before Troup County Georgia (LaGrange, Ga.) Probate Judge Donald W. Boyd (who DOES NOT hold a law degree) who granted Beth Gaddy emergency guardianship of Mae Magouirk, giving Beth Gaddy full and absolute authority. Thus, they COULD NOT MOVE HER FOR PROACTIVE MEDICAL CARE Friday because Beth Gaddy had Hospice stop them and then she had Mae’s IV fluid tube pulled out. Beth Gaddy has repeatedly told Mr. McLeod, Mrs. Mullinax and Kenneth Mullinax that she feels they all should let Mae not eat and thus cause her to die because, and we quote Beth Gaddy: “Grandmamma is old and I think it is time she went home to Jesus. She has glaucoma, and now this heart problem and who would want to live with disabilities like these?”

As stipulated under Georgia Law, a hearing for an Emergency Guardianship, must be held within 3 days of its request and Mae Magouirk’s hearing was held on this past Monday, April 4, before Troup County Georgia Probate Judge Donald Boyd who favors granting Beth Gaddy permanent guardianship and thus will seal Mae Magouirk’s fate of allowing Beth Gaddy to starve her to death against the wishes of her Living Will and in full knowledge that Mae Magouirk is not terminal, not in a coma and is not in a vegetative state and that medical care at UAB Medical Center is awaiting her. Shiavo revisited!

Mae’s present state and vital signs Mae’s blood pressure is good, averaging 140/82 with a pulse rate of 88. However, since admission to Hospice she has not been lucid but who would be since nourishment and fluids have been denied since March 28, 2005. Also adding to her confusion is that she is off her regular medicines and is on a dose of Adavan and Morphine. Without food or water her electrolytes and body chemistry is not within its proper parameters. If her condition is not given major public attention soon, she will die, not by divine cause but by the omission of assistance by man. WE MUST GET Mae moved to UAB Medical ASAP

If I hadn't spent the last year and a half fighting tooth and nail to save Terri, I wouldn't have had a clue what to do for Mae. I'd bet not too many others would either. By the time I heard about it and started making phone calls, so many Freepers had already called the granddaughter, her phone line was fried. This is the kind of action that saved Mae. Without Terri, most of us would still be running around today asking "What should we do?"

Terri's death was tragic, horrific, sinister, etc. Terri's death was a lot of things, but it was not in vain.

Mae Magouirk, the 81-year-old Georgia widow over whose medical care a family tug-of-war reminiscent of the Terri Schiavo case has been raging, has been transported from the hospice in LaGrange, Ga., to the University of Alabama-Birmingham Medical Center, according to her nephew, where "she is receiving food, fluids, cardiac care and neurological help."

This morning, Magourik's nephew Ken Mullinax, who had been fighting to have his aunt removed from Hospice-LaGrange in LaGrange, Ga., where, he said, she had not been properly fed or hydrated, contacted WorldNetDaily with this phone message:

Because of your articles and all of the friends of Terri, my Aunt Mae Magouirk is now in the University of Alabama-Birmingham Medical Center and is receiving food, fluids, cardiac care and neurological help. We are overjoyed.
Praise be the name of the Lord, praise be all of the friends of Terri Schindler [Schiavo]. We could never have mobilized public sentiment and pressure on these people in LaGrange, Ga. – at Hospice, the LaGrange, Ga., doctors or the probate judge – unless the friends of Terri and the wonderful media of WorldNetDaily.com had become involved. Thank you all.


Under the terms of an April 4 court order, Magouirk's medical treatment was to be decided by three cardiologists tasked with deciding what treatment would be best and where it should take place.

Pending that decision, Mullinax, 45, has contended that his aunt had been without substantial food or hydration for 10 days at the hospice.

ty, Sun. My greatest satisfaction, honestly, after Mae being delivered from harm first, of course, was that Focus on the Family contacted eeevil within hours of my e-mail to them. (I happened to send a very long e-mail fully of my research with url's regarding the pro-death agenda, just days before.) I have no doubt others must have told them about Mae, too.

Why is this so important to me? Because, I know they "get it" and they're not just talking and wringing their hands. They obviously are involved and are WILLING to listen.....to "nobody's." They're "on board." Yippeee!!!

My Reply: So true, so very true. And there are a lot of us who carry that, "been there done that," knowledge around with us so now we know what to do, how to do it, and we know how important it is to act quickly, once the basic fact checking on the report is done (Thanks to YOU, Smelvin and eeevil conservative for investigating early on Mae Magouirk's situation).

I hope the Schindler family will derive some satisfaction knowing that becasue of Terri a small army of us are ready to engage the enemy and we will WIN some battles. Eagels Up!

Thanks for mentioning me, but I think my greatest contribution was the phone calls I made. By the time I made them, so many others had already called the granddaughter, her phone line was fried. I have to face the reality that compared to other Freepers, I didn't do much. But boy oh boy, man oh man, do I feel EUPHORIC over our collective success!

As an added bonus, I realized that Kenneth spoke up for Aunt Mae, and showed everybody what the frequency is.

Not me...I think they've gotten hundreds of e-mails regarding Terri. I suspect they got quite a few concerning grandma Mae. However, I also believe that because of my very lengthy e-mail days prior (about 3 pages long, complete with url's to cases regarding dehyrdration, the President's Commission of which Dr. Cranford was a co-author of two, who testified that Terri was PVS, links to his website, showing he, indeed is a co-author, links to the bioethics website where some of the documents are available for download, etc., and, of course, after what just happened to Terri, all of these things may have caused them to take the concern very seriously instead of being in disbelief or totally skeptical).

I'm glad they are that concerned.

I think you are mistaken. Unless there were other Action Mae Magouirk thread on FR, it was only after you, smelvin, and eeevil conservative reported back in ON THIS THREAD, that we organized.

Terri's Bloggers may have been making calls, but on this thread it was your work that put the Freepers into action. Not to say that other's weren't on it, but on FR you and smelvin and eeevil conservative were the 3 people, it was your work, you 3 reporting in, independently, on all the phone calls you made, that started it on FR.

Now I might be mistaken if there were other threads but I know on this one, it was you 3 and you 3 alone that got the rest of us the validation we needed before we took action. We want to help but we also want to know that the report is not a hoax. You 3 showed the rest of us that it wasn't a hoax.

YOU should feel EUPHORIC, we all do, but you 3, well gosh you know, you were out there in front early. Many many thanks. If it were not for you 3 doing the validation I know I would still be hanging back.

Has anyone confirmed this? I haven't seen any proof that she was being denied food and water anywhere except quotes from Ken. The judges orders specificly said she was to be given food and water. In the article at this link the judge says Ken's claims are false and the CEO of the hospise states that "No patient at our hospice is denied food or water". http://www.11alive.com/news/news_article.aspx?storyid=61478

#1: Hospice is a place to go to die. It's stranger that a woman who was not comatose, not vegetative, not terminal was illegally placed there; #2, a nurse, according to Kenneth, told him that she was not being "substantially" nourished; #3 the granddaughter does not deny claiming, by anyone, her attorney or anyone representing her, that she said "Grandmama is old and I think it is time she went home to Jesus. She has glaucoma and now this heart problem, and who would want to live with disabilities like these?"

The more one looks into this sordid case,
The clearer the evil plot.
They're not trying to starve her because she's dying,
but rather because she's not.
It's clear Michael Schiavo, George Felos, and Judge Greer
Are fighting with all their might
Not because Terri won't speak up,
But rather because she might.

Hopefully you wont' write another verse right away. Give it some time. See how many more Mae Magouirk's there are. perhaps verse 4 it will write itself....

May I say, you are the most reasonable persons I have seen commenting on this matter. I say that for many reasons, one is that I haven't been totally reasonable at times with a poster or two on this matter.
