Court to hear the scoop on dog's poop

INDIO, Calif. - A blind couple is headed to court to resolve a dispute with their homeowner association about droppings left in the street by their guide dogs.

Dennis and Shirley Bartlett are aware of the pooper-scooper rules for their Desert Grove homeowner association, but said they sometimes miss droppings left by their dogs.

"You can't get everything all the time," Dennis Bartlett said.

The Bartletts filed a small claims suit against former association president Delmar Pierce, alleging harassment and prohibiting their guide dogs from doing what they were trained to do - defecate in the street. The case is scheduled to be heard Sept. 22.

Pierce didn't want to discuss the case, noting he's only had one conversation with Bartlett.

"During that private conversation all I said was, 'We need to talk about your dogs and relieving themselves in the streets,'" he said, adding that Bartlett doesn't want to abide by the rules of the gated community.

Association attorney Margaret Wangler said the association never told the couple not to use the streets.

"The association's concern and the reason for getting in touch with the Bartletts was that they don't clean it up all the way and that's a health and safety concern to the board."

I suppose the attorneys will recommend they hire a sighted person to walk their dogs. I don't know what the legalities of that are.

LOL! The dogs are 'hired' to walk these people.... walking outside is their job ;~D

I just think the neighbors worrying about this kind of stuff is ~the~ symptom that life is pretty darn easy in this country.

Maybe you don't live in a populated area. I do, and it's a good rule. That's why those "clean-up" businesses sprung up.

The only part that offends me is they advertise on the paper placemats at one of my favorite restaurants.

Dog cleanup rules are good. Not bending those rules for the rare seeing-eye dog is what is completely whacked.

Check this out! Dog poo in the street is a major tragedy, yet the daily killing of unborn babies through abortion isn't horrific and horrendous?

This is a fine example of the insanity of zero tolerance.

If there were any people of decency in this neighborhood they would help out. I would help a stranger in this situation. Blind man trying to find dog poop, what's he going to do, pat the entire street to find it when the dog has just passed gas?

Hey, I have a suggestion for these (pardon the pun) Anal Retentive homeowner's association jerks.

How about doing a little community service, and take turns helping the blind owner clean up after his dog, instead of taking him to court?

Decent people help their neighbors.

I think this is frivolous, heck if I used a sighted guide dog instead of being so stubborn and only use my cane like I do a lot, I'd do the same thing and not pick up the crap, it's hard to find that stuff on a lawn to pick up when you're blind, these snooty yuppie jerks should getthe sticks out of their butts and complain about something more important like higher taxes or who's going to pay for Buffy's private school fundings, lol, from one blind man to the rest of the FR community, Im' laughin at this story
