Judge orders Trump White House to restore AP access

THE HILL – A federal judge on Tuesday ordered the Trump administration to restore the Associated Press’s access to key White House spaces after it exiled AP reporters over the organization’s refusal to use “Gulf of America” in its popular stylebook.

U.S. District Judge Trevor McFadden, an appointee of President Trump, directed the White House to resume allowing the AP into the Oval Office, Air Force One and other limited spaces when they’re made available to other press pool members.

The judge also granted the AP’s request for returned access to events open to all credentialed White House reporters, though it listed several caveats.

“This injunction does not limit the various permissible reasons the Government may have for excluding journalists from limited-access events. It does not mandate that all eligible journalists, or indeed any journalists at all, be given access to the President or nonpublic government spaces. It does not prohibit government officials from freely choosing which journalists to sit down with for interviews or which ones’ questions they answer. And it certainly does not prevent senior officials from publicly expressing their own views,” McFadden wrote.

“No, the Court simply holds that under the First Amendment, if the Government opens its doors to some journalists—be it to the Oval Office, the East Room, or elsewhere—it cannot then shut those doors to other journalists because of their viewpoints,” he wrote. “The Constitution requires no less.”

This ruling it senseless, it says to restore the access but does not prevent the WH from not picking them to be part of the briefings. Utter nonsense.

Also it runs afoul of security clearances such as AF1, no judge can tell the president who is allowed to fly on his personal plane.

The best, the most effective, the most practical, the most important thing to do is to start ignoring these rulings. "Constitutional crisis" as the panic-stricken so often scream? You betcha! ... A "Constitutional crisis" of the Judicial Branch failing to recognize the separation of powers basis of the Constitution. It's time these judges do so, with or without the USSC's involvement (Roberts prefers not to make decisions anyway so I don't think he'll mind sitting this out, literally, on the bench.)

I wonder how this judge would feel about being told he has to allow all press into all his court proceedings. How do judges get to limit court hearings but the President, a co-equal, co-sovereign branch can not do similarly.

As I’ve stated previously, if you look closely in the Constitution, you can find the “Trump exception” to all laws, rules, regulations, and legal precedence. It is plainly there for all to see.

If someone points out the hypocrisy or double standard you see in the Courts especially when it comes to “standing”, just yell “Trump exception!” and you will automatically win the argument.

I'd like to see the Trump administration begin responding to these activist judges who are out of their lane. Something like:

"Judge Smith, your ruling/pronouncement assumes Executive authority. You have no Executive authority, therefore your ruling/pronouncement is ignored. We are directing the Supreme Court and Congress to correct your illegal behavior."
