Dem AGs Claim DOGE Is "Unconstitutional and Illegal" [semi-satire]

Michigan Attorney General Dana Nessel along with the AGs of 13 other "blue states" is suing to have a "federal court declare the establishment of the so-called Department of Government Efficiency and the appointment of Elon Musk to head it is unconstitutional and illegal. First, Congress has not approved the establishment of this agency. There is no designated set of officers to run it and no appropriation of funds to pay for its activities."

"Second, heads of federal Departments must obtain the consent of the Senate," Nessel pointed out. "Consequently, Musk has no authority to act on behalf of the government until Senate consent has been achieved. Trump hasn't even presented a request that the Senate advise and consent to Musk's role as Secretary of DOGE."

"Third, DOGE's unauthorized activities are solely focused on cutting government expenditures and staff," Nessel complained. "As I read the Constitution, I see that Congress has the power to spend. I don't see any clause granting Congress the power to save. So, even if Trump wanted to get Congress to approve the creation of DOGE, there is no explicit grant of such power in the document."

"Fourth, under the law there is a right called an 'easement' where continued use of someone else's property for an extended period of time creates a permanent right to use that property," Nessel asserted. "Since the Government Accountability Office admits the fraudulent payments have been made for decades the recipients of those payments now have a permanent right to continue receiving them. No actions taken by DOGE or President Trump can be allowed to take away these rights."

As I read the Constitution, I see that Congress has the power to spend. I don’t see any clause granting Congress the power to save. So, even if Trump wanted to get Congress to approve the creation of DOGE, there is no explicit grant of such power in the document.”

But she doesn’t have the evidence of that and can’t find any because she’s been busy baking cookies and she lost her copy of the U.S. Constitution.

There is no reason for Congress to approve DOGE; Trump’s advisors simply suggested that the President repurpose an O-hole Obamacare bureaucracy devised to pilfer tax dollars (USDS) foe the purpose of conducting financial and transactional audits of departments controlled by the Executive Branch. The Constitution does not explicitly state that the President cannot set up a committee to investigate or recommend actions on the federal government. And he actions they reommended were done by Trump, not DOGE. Congress makes the laws with the approval of the POTUS but it is the responsibility overall of the POTUS for the safety and security of the populous.

Not required for a POTUS committee to investigate fraud waste and abuse for him to take action on. If that was the case, then all the little people that work for the congress people are officially out of a job and everey investigation they mke must be made public prior to initiating.

Yes they do. Buit they have limitation based upon a number of situations. One might be conflict of interest.

As defined by Black’s Law Dictionary (7th ed.), an easement is. An interest in land owned by another person, consisting in the right to use or control the land, or an area above or below it, for a specific limited purpose. You can’t ease someone’s propterty for indefinate use for a specific limited purpose.

And finally, “ “Since the Government Accountability Office admits the fraudulent payments have been made for decades the recipients of those payments now have a permanent right to continue receiving them.”

It can be possible that the payments in the eyes of the recievers were not fraud or embezzlement, but now that it is determined it is illegally earned money, then any further distribution of the funds by the treasurey is unlawful.

An example would be capital punishment. The states have the right to apply capital punishment under certain crimes. But does that mean they can just execute someone because they did it in the past and arbitrarily lower the level of determination so a jay walker can get the chamber?

Musk and his DOGE team are consultants. He has no authority to DO anything. Musk reports his team’s findings to Trump. Trump makes the decisions.

I guess Dana was asleep during any class on government organization. Remember all those czars set up under obammy. I don’t recall Congress establishing them in law.

According to my copy of the US Constitution Article 1 Section 9 Paragraph 7, where is the copy of the listing of money spent, and where was it published??? Nowhere because the books have not been looked at since 1949. Yeah, 1949 looks at the UN spending as so bad that by us stopping funding the Alien immigration agency, the UN has saved so much they laid off over 300,000 folks how that. For saving, and BTW, that saves the UN over 500 billion in pensions a year...
