No, Symone! A Third-Party Candidate Won't Deprive Biden or Trump of 270 Electoral Votes

Today, in a segment devoted to trashing third-party candidates because of the likelihood that they would take votes from Biden, Sanders revealed her unfamiliarity with the way that Electoral College votes are awarded. Sanders:

"I think now more than any of our past recent elections, that third-party candidates are a true, true threat to Joe Biden, but also to 270, period. Our Constitution says, to be the President of the United States, you have to win 270 Electoral College votes. Not 269, not that majority rules all . . . Now, what if Joe Biden is denied 270? Or Donald Trump? Well, according to the 12th Amendment, the House gets to pick who the president is."

What Sanders fails to grasp is that in every state but Nebraska and Maine, whoever wins a plurality of the popular vote wins all of the state's Electoral College votes. So even if a third-party candidate denied either Trump or Biden an outright majority in a given state [or in one of Nebraska or Maine's electoral districts], so long as either Trump or Biden got more votes than any other candidate, they'd get all of the state's electoral votes [or the electoral vote in the Nebraska or Maine district.]

Thus, the only way that Sanders' nightmare scenario could come to pass would be if one of the third-party candidates actually won a state, or one of Nebraska or Maine's districts. And not even the most fevered conspiracy-mongers have suggested that RFK, Jr., let alone Cornel West or Jill Stein, have any hope of pulling off such a miracle.

This is the second week in a row that Symone Sanders has exposed her, how shall we say this, unawareness of the facts.

You see what she got wrong here. Last week she claimed that Trump “promised carnage” in his inaugural address. In fact, he promised to STOP it!

She is an embarrassment. But would MSNBC dare remove her?

DEI. Unless Sanders or anyone else can name a SINGLE STATE that JFK or any other 3rd party can win, then either Trump or Biden’s people will get at least 270 EVs.

I'm really sick of these cookie cutter distaff commentators. They are interchangeable, IQs according to the book. They are usually wigged up, but this one flipped hers at home. They all look alike to me anyway.

The Founders imagined that this would happen all the time.

Therefore, they provided for it as they did for everything else.

Since the States appoint the President via their Electors, when no candidate has a majority of EVs, the House elects the President from among the top 3 candidates, WITH EACH STATE HAVING ONE VOTE. California = 1 vote, Wyoming, 1 vote.

In case the House cannot achieve a majority for a candidate, the Vice-President elect acts as President, chosen by the Senate from among the TOP TWO candidates, with each Senator having one vote and the President of the Senate there to break a tie, so there cannot be a tie and someone will be ready to serve on January 20.

People treat the Constitutional process as if it's a big problem, a "crisis" even - when it should be regarded as perfectly ordinary.

What if they did? Even in the unlikely event that either candidate was denied 270 electoral votes, There has to be some tiebreaker. This is the system we have. Would it be better to make all third parties illegal?

We do have a way to deal with less than 270 EVs, each state gets one vote.

But no, Third Parties are VERY IMPORTANT for two reasons:
1. They can cause weak candidates to lose, decisively (as Bush Sr. did, and Biden may well do).
2. They can possibly win the top job, as Perot was close to doing, until he called it off.

In 2020, Trump lost GA, WI, and AZ, by a total of 43,000 votes.

If Trump actually won those three states, the Electoral Votes would have been tied 270-270.

Biden received 1 EV from Nebraska. Biden won that Congressional District with 56% of the vote.

Trump received 1 EV from Maine. Trump won that Congressional District with 52.3% of the vote.

The 2020 election would have gone to the House of Representatives, where each state gets one vote.

In November 2020, the Republican Party had a majority Congressional delegation in 27 states.

The Democrats had a majority delegation in 23 states.

In theory, Trump would have won 27-23.

But, nothing is ever certain with Trump (or Conservatives) vs. RINOs.

the last third party candidate to win ANY electoral votes was George Wallace over half a century ago

Abolishing the EC system for a popular vote will give more political power to states that are ok with padding their popular vote totals with lax vote verification. The more corrupt the state’s government, the more padded their state’s popular vote will be. How long before an arms race of competitive fraud?

I am not a fan of Kennedy with a few exceptions on which he is right, covid, the FBI, the CIA and the deep state. However, he is a liberal at heart but I respect his honesty.

What the Democrat Party has done in trying to get him off the ballots of various states is totally anti democratic.

“You will not be president Mr. Kennedy. I applaud you for showing the corruption of the Democrat Party. We need a similar type to you in the Republican Party to show its corruption also. The old guard of the Republican Party has tried to do to Trump what the old guard of the Democrat successfully has done to you. You have my respect.”
