Trump's Lawyer John Lauro: Newest Indictment Gives Trump Legal Power That He Never Had Before
The Gateway Pundit ^ | August 3, 2023 | Randy DeSoto

Former President Donald Trump attorney John Lauro sees at least one silver lining in the Department of Justice’s latest indictment of his client: Trump will get to litigate why he believes the 2020 presidential election was fraudulent.

“In 2020 Mr. Trump’s campaign had a few weeks to gear up and present evidence, and it was very difficult,” Lauro told Fox News host Bret Baier Tuesday night after special counsel Jack Smith announced the 45th president was being indicted in relation to his questioning of the integrity of the 2020 election.

“We now have the ability in this case to issue our own subpoenas, and we will re-litigate every single issue in the 2020 election in the context of this litigation,” Lauro added. “It gives President Trump an opportunity that he has never had before, which is to have subpoena power since January 6 in a way that can be exercised in federal court.”

Trump created “widespread mistrust” in his attempt to “overturn the legitimate results of the 2020 election,” Smith alleged.

Further, the former president knew that his allegations of election fraud were false when he made them, the special counsel added.

Lauro refuted that Trump knowingly made false statements about the election, but even if he did, it is still protected free speech under the First Amendment.

“It’s not just issues of fraud. It’s also the fact that procedures were changed, undeniably so, that procedures at the state level were changed without the ability of the legislature to weigh in,” Lauro explained.

Trump’s intention on Jan. 6, 2021, was to pressure Congress not to certify the Electoral College vote, so the state legislatures could have one last chance to review and weigh in on how the elections in their states had been conducted.

Great news for Trump. As for Brett Baier, his anti-Trump mindset is in full form.

The communist judge will attempt to quash all of this.

Or maybe they will just change the rules and stack the deck.

By now most of the evidence has been lost or destroyed, surely.

Here’s hoping that they turn this fiasco into a trial about the 2020 election. Because the fact remains that about 40% of the country still thinks the election was stolen, and another 20% thinks that there was a ton of fraud that may have impacted the outcome, and another 20% thinks that the election was stolen but are good with that.

Consider that this isn't about actually "litigating" the 2020 election.

I think that what Lauro is saying that in order for President Trump to present a defense that he actually believed that he won the election and it was stolen from him (his 1st amendment right to speak out), then they have to show the evidence of WHY Trump believed what he did.

They have to show the reports of:

All of these things would add up to a general belief that, state by state, coordinated shenanigans were in place to tilt the vote just enough to cause the state to go for Biden.

The defense will have to "relitigate" these things in order to present a pattern of facts that led President Trump to the good-faith conclusion that he reached, and that his speaking out against it was protected speech and a petition to the government for a redress of grievances.

She has a problem. Smith’s indictment alleges the President knowingly made false statements. If Trump choosrs an affirmative defense then he has a right to eother prove his statements true or prove belief they were true to be reasonable. She cannot deny him any evidence or witness that goes to those ends. Smith can withdraw that part of the indictment, but then his whole case falls apart.

There’s nothing “retard” about it.

The defendant in a criminal trial has a constitutional right to secure evidence and call witnesses in his defense.

Right now, I’m not sure if Nancy Pelosi or Joe Biden will be the first person named on Trump’s witness list. Both of these people could be sitting through dozens of hours of depositions if this case isn’t dropped by the prosecution.

She can do whatever she wants until/unless some higher court stops her and orders her to do so.

I can speak for myself only, here, but my huge distrust of the American electoral system is purely based on widespread DEMOCRAT Party misconduct, conflict of interest, and the appearance thereof.

Yes ... Hillary Clinton and her cronies were colluding with Russians to produce false accusations against then President Trump.

I don’t think the Democrats wanted all this to actually go to court (where real evidence would be required) as opposed to trying the case in the media where anything can be claimed and nothing has to be proved.

Some pointed out that the presiding judge could block a defense by Trump but that would just kick it up until it reached the Supreme Court.

The Democrats expected President Trump to fold by now. They have built a house of cards and a real trial will expose it for what it is, using the full power of the government against one man to protect their corruption.

I like the Matt Gaetz approach to this. Because the Judge will just shut down Trump and not allow him to subpoena anyone. And the DC Jury will be rigged.

Gaetz wants to have Trump testify under oath and give him immunity, which then means none of that can be used against him.
