The city medical examiner has ruled the death of a homeless man choked by a Marine on the subway earlier this week a homicide — as prosecutors mulled whether to pursue charges.
Jordan Neely’s cause of death was “compression of neck (chokehold)” and the manner constituted a homicide, the medical examiner determined Wednesday afternoon.
Neely, 30, was reportedly homeless and having a mental episode onboard an F train in lower Manhattan Monday afternoon when another straphanger jumped in to restrain him, according to police and witness accounts.
The wannabe vigilante, identified as a 24-year-old Marine from Queens, took down Neely from behind and placed him in a chokehold for about 15 minutes, police said.
Neely passed out and when EMS arrived, they were unable to revive him.

Sudden withdrawal from Ativan will make you crazy! A quack gave me that crap for a digestive problem. It was bad so I stopped it and it about killed me.
I get that the Marine was trying to do what he thought was the right thing. But the homeless guy had not touched anyone yet. Homeless guy probably was saying things that could be interpreted as threatening, but that’s not enough.
A NYC district attorney and then a NYC jury will judge this Marine. He is in serious trouble.
The white guy is the only one that counts...
If he were on a plane and started yelling about how he didn’t care if he died and threatening people, how would that go for him?

this is preposterous....the justice system let rape and assualt and death roam all the subway and metro platforms with people actually being throw to their deaths by these animals and then they wonder why people react?....

The same question could be asked if the homeless guy were on a bus, and lunged at the driver. But neither scenario applies here. The prosecutor will tell the jury that any response must be proportional to the threat. And the Marine’s response was over the top.
I’m no lawyer. And I don’t play one on TV. But I suppose the Marine’s best hope is that some witness actually heard the homeless guy make overt threats.
Physical violence is now a mental episode? A person protecting law abiding citizens is now a vigilante? This is how communism works. Wakeup or become comrade 1984.
I have a lot of professional experience with Ativan as a former psych nurse. It was our main ‘deescalation’ Rx on the wards at Napa State Hospital. What you say about it is correct. Ativan, like it’s sister benzodiazepine Xanax, has a shorter half life than other medications in the class, so when people come off of it they tend to ‘crash’ faster causing irritability and agitation. It’s a very bad medication to give recovering alcoholics because of this because they will tend to self medicate with alcohol when they crash down off the prescribed Rx.

Actually that scenario does apply here because his fellow passengers were locked in a compartment with him and he was threatening them. Were they supposed to wait until he made good on his threats? You do know there were four men restraining him, not just the marine?
