A draft decision indicates that the U.S. Supreme Court is poised to overturn the controversial Roe v. Wade decision that established abortion rights in 1973.

The draft is written by Justice Samuel Alito and was reportedly circulated inside the court.
“We hold that Roe and Casey must be overruled,” he writes, referring to a separate decision that defended abortion rights. The leak of a draft opinion is unprecedented in the modern history of the Supreme Court.
“Roe was egregiously wrong from the start. Its reasoning was exceptionally weak, and the decision has had damaging consequences. And far from bringing about a national settlement of the abortion issue, Roe and Casey have enflamed debate and deepened division," Alito continued.
"It is time to heed the Constitution and return the issue of abortion to the people's elected representatives," he adds. The draft decision is related to a challenge against the abortion decision by a Mississippi pro-life law.
“The inescapable conclusion is that a right to abortion is not deeply rooted in the Nation’s history and traditions,” Alito concludes. "On the contrary, an unbroken tradition of prohibiting abortion on pain of criminal punishment persisted from the earliest days of the common law until 1973."

This was done with the tacit approval of one of the Supreme Court Justices, possibly Sotomayor or possibly even John Roberts (I wouldn’t put it past him). No clerk is going to fall on their sword without having an escape career and promise of a job beforehand. I smell a big black robed Justice Rat, a DemocRat.

Nah, it’s real. 98 pages with footnotes? All thoroughly, expertly stated? I’m sorry, but anyone capable of pulling off such a prank is likely too busy to do so, as they’re making $800/hr as a lawyer.
Don’t forget that the court has IT staff and many of them would be liberals. They could be the leak source. And of course there are executive branch agencies that could acess the court’s systems.

It certainly looks like a proper call...laying out that before Roe....the states did have there own laws...and effectively their own precedence. Roe neglects to acknowledge the precedence of the state. The appendix showing old state laws is an important if not the most important part of this decision.

Appendix shows 37 states had laws in the 1800s making abortion a crime. At some point, I believe ALL states had a law making abortion a crime.

In 1900, abortion was illegal in every state. That makes it a states rights issue. Roe vs Wade should never have gotten to the Supreme Court.
