If a mistrial is declared it can be with or without prejudice. With means they CANNOT refile the same charges and without prejudice means they MAY file with same charges.

The judge was abundantly clear that he’s this >< close to declaring a mistrial with prejudice. There is no doubt the prosecutor has no case, and has been pushing hard to get a do-over, which the judge isn’t going to give him.
