IL:Cook County Bans More Guns

This ban and restrictions appear blatantly unconstitutional under Heller and McDonald.  I am sure there will be court challenges.  Too bad the commissioners will not be held personally accountable for their lack of responsibility.   From the Daily Herald:


The Cook County Board Wednesday voted to ban the sale of guns to people under 21, restrict how people with children at home store their ammunition and add firearms to its list of banned so-called assault weapons.

The votes come as suburbs have until midnight Friday to approve their own assault weapons bans, though few have expressed much interest in doing so. Cook County Board attorneys said they believe because they already have a ban in place, they can change it whenever they want. But getting in under the state deadline could prevent some legal challenges.
The Heller decision clearly stated that there is a Second Amendment right to have handguns available in the home for self defense.  To require those firearms to be locked up violates that clear ruling.  There are numerous other potential challenges to this law, such as banning commonly available handguns.

While the Heller decision has resulted in handgun bans being repealed, it (unfortunately) has not prevented magazine restrictions, waiting periods, or "assault weapon" bans. Those are, by the current interpretation of the Supreme Court, constitutional.

“shall NOT be infringed”! That means by NO entity, Federal State, or Local! Nor by individuals, school districts, counties, etc.

Want to stop the gun violence in IL? Give firearms to all non-felons, the training to use them, and a decent Stand-Your-Ground statement. After the first few thugs get iced, the word will get around and the numbers will come down...

Here’s an idea, why don’t the police disarm the Gangster Disciples and the Vice Lords instead of law-abiding people? That might actually reduce crime. No. That makes too much sense.

This is the same mentality that ignores the fact that lower tax rates increase revenues.

By their reasoning, if they can reduce guns, then murders will decrease. Just like their reasoning that increasing taxes will result in increased revenues, which never happens.

So, if we can draw a parallel, restricting guns increase the murder rate while more guns reduces the murder rate.

That is why Chicago is on-tract to have over 600 murders, again this year.

Well, the police should do some something other than give people speeding tickets, eat doughnuts, and respond just in time to draw little chalk outlines around the bodies they find.

I know, not fair to say.

Right. Glad to see police are trying to target the right people. Going after the people responsible for gun violence and other crimes the right thing to do. Preventing law-abiding citizens from purchasing a gun is not. It is also unconstitutional.

I’m kind of happy they passed this ban: it will be struck down by the Federal courts, and then under the new Illinois law, they cannot enact another to replace it.

There's some tension regarding the "common use" standard in Heller: by that standard, most AR and AK variants are in common use.

In addition, the 7th Circuit has raised the standard of review for gun control laws: they have to prove not only that they have a rational basis, but also that they have a reasonable probability of reaching the stated goal in the least intrusive way possible. The 7th Circuit is edging closer to a strict scrutiny test, which follows Heller insofar as the 2nd Amend is a "fundamental" right.

Of course, under strict scrutiny, the whole Illinois gun control apparatus (including FOID) goes away: nothing like waiting weeks for a FOID when you need protection immediately.

Perhaps Illinois should just register everyone for a FOID when you obtain or renew a drivers license, just like voting./s

I’d love to see bans on normal capacity magazines and “assault” weapons go away. If Obama manages to appoint another Supreme Court justice or two, though...forget it.

I think we'll have to wait until 2017 to have even the slightest chance at a decent President.
