The US government has been slowly eradicating the Posse Commitatus Act of 1878. That act banned the US government from using the US military in domestic law enforcement. Over the past few decades the US government has repeatedly violated the act. However, many Republicans have insisted that the Posse Comitatus Act needs to be respected to protect the rights of American Citizens.
South Carolina's left-wing Republican Senator Lindsey Graham, however, is supporting provisions to eradicate Posse Commitatus and dramatically expand the powers of the Federal government.
The US Senate Armed Forces Committee, led by Carl Levin (D-MI) and John McCain (R-AZ), held a secret closed door session to insert ominous new Federal powers into the Defense Authorization Bill. This is the annual bill to fund the US military. These new powers were requested by the Obama administration.

Yeah, but it only applies to “custody”, not be arrested by them. They’ll just claim, they’re not in custody, but en-route to the local jail authorities.

Absolutely crazy. They are using the Christmas Day bomber as an example of why they want to detain anyone for as long as they like without access to a lawyer or judicial process.
Massive growth of Federal powers. Clear violation of the constitution. The USA, liberty and life as we truly know it is being quickly eroded through the reaction to terrorism.
Hell, the Delta Force took out the Christian David Koresh and his followers in Waco TX. This government doesn't need laws to break, they do what ever they damn well please and that includes murdering US civilians. Posse Commitatus my aching a$$. The military needs to be turned loose in DC to clean out the rot and corruption.

But why did we take out the language Senator Levin wanted me to put in about an American citizen could not be held indefinitely if caught in the homeland? The administration asked us to do that. Why did they ask us to do that? It makes perfect sense.
If American citizens have joined the enemy and we captured them at home, we want to make sure we know what they are up to, and we do not want to be required, under our law, to turn them over to a criminal court, where you have to provide them a lawyer at an arbitrary point in time. So the administration was probably right to take this out.(page 45)
This shows that they know the citizen language is too gray, otherwise why add it then remove it or even talk about it. Plus any McCain bill should be scrutinized, especially after his McCain-Feingold act was declared partially unconstitutional.
Forget Waco, Ruby Ridge, etc.. the US government has been slowly eradicating the Bill of Rights. The eradication has accelerated since about 1967.
Methinks this "eradicating," might not end well.

Nothing is stated exempting U.S. citizens from detainment in SEC. 1031. AFFIRMATION OF AUTHORITY OF THE ARMED FORCES OF THE UNITED STATES TO DETAIN COVERED PERSONS PURSUANT TO THE AUTHORIZATION FOR USE OF MILITARY FORCE
In addition the language used for U.S. citizens and legal resident aliens under SEC. 1032 says: ...THE REQUIREMENT TO DETAIN... Meaning they may if they choose to, just not required.

There is nothing in the Constitution that says enemy combatants in this country cannot be killed by American troops.
That would not have been put there by a group of Founders who had fought on our own soil against British, Indians, and saboteurs.
The point of posse comitatus was to not use the military for normal law enforcement.
As well well know from Kent State, the National Guard can be used as governors of the states determine.
That is why we have police and the FBI. There is no reason for the military to be involved. I dont forsee any reason that a Tomahawk cruise missile will be needed to go through a front door in America.
