Fox News’ Andrew Napolitano wants to set free Oregon Christmas tree bomber. On last night’s O’Reilly Factor, prominent judge and libertarian thinker Andrew Napolitano was on as a guest to discuss his controversial, to say the least, opinion on what to do with the 19-year-old Christmas tree bomber in Oregon. Somewhat surprisingly, the judge actually wants to set free the terrorist Mohamed Osman Mohamud because he argues that the US government coerced the lad into wanting to kill Americans at Oregon’s tree-lighting ceremony. However, the judge may actually be on the wrong side of the law on this very shocking issue since the Supreme Court has ruled that coercion or entrapment is not a valid defense if the accused wanted to commit the crime.

Napolitano is a Libertarian, not a Conservative. He is consumed with his utopian ideology and out of touch with reality.

He is the kind who would free a mass murderer on a technicality in order to remain staunchly faithful to his vision of Libertarian perfection.

Then, when the murderer killed a few hundred Americans, he would happily declare "The operation was a success, but the patient died."

There is a fine line between what law enforcement did and entrapment. Because of this law enforcement is careful not to cross the line. In effect, it gives the perp enough rope to hang himself, but does not do anything to force him.

The Judge said “thinking about doing a crime is not a crime”. That is true, but he was in full consciousness carrying it out. And we are not talking about knocking off a 7/11 or bank, we are talking about blowing apart hundreds of people and incinerating hundreds more, including little kids, and sending this country into a terror alert level like we have never seen. Terrorism should be treated on a different level - period.

Early stories indicated the perp dialed the cell phone number TWICE- with the informants questioning after the first try failed, whether he REALLY REALLY wanted to do this and kill a lot of women and children

I hope the swooping in after his second deliberate effort and him been presented with the chance to walk away and the probable results of his actions- will override “entrapment” argument

It sounded like they gave him many efforts to back away from doing this and made sure he KNEW what he was doing

You just never know with Nappy. He’s a character. I appreciate his views on issues- but definitely think he’s way out there sometimes. This is one of those times.

Libertarians can be dogmatic. Stossel is the same way- though I think he’s terrific and am glad he’s a voice for sanity in many instances.

Yep. And not only that:

He has also been pimping the theory (along with “nuclear physics expert” Jerome Corsi) that TSA’s new nude-scanners emit dangerous radiation. That’s pure baloney.

Now if you want to object to the scanners as invasions of privacy, that’s plausible. It’s a respectable opinion. But on the other hand, it’s a downright falsehood to say they present some kind of radiation danger.

I’ve wondered about that. It seems that when all the other Fox hosts and hostesses are prattling on about their spouses and children, he’s silent.

They do.

But at a tiny dose, roughly equivalent to 2 minutes of flight time at cruising altitude.

Our understanding of the exposure risks of radiation is quite thorough, much better than for most chemical exposures, and it is well documented that risk is proportionate to dose. This is a very low dose.

Indeed! You make my point, specifically this:

It’s totally dishonest for the Neapolitan Judge, his fellow Italo-American Jerome Corsi, and assorted other commenters to suggest that the radiation is in some way dangerous. It just ain’t.

Entrapment or not is not the real issue. Do we really want the FBI to latch on to a kid with weird ideas, nurture those ideas, coax him along and train him until the time he is ready to commit a crime, then arrest him when he tries to commit the crime the FBI trained him for and helped him to attempt?

My question is why in the hell did we import all these Somalis in the first place? They tried their best to kill our guys back in the 90’s and we reward them with a free pass to the US?

The Judge seems to have a recurring problem with law vs his opinion. Numerous times, he has made commentaries that oppose the law.

That may be why he is a commentator and not a 'sitting' judge.

Maybe ALL Nazis were "coerced" into being Nazis. Maybe Goering was "coerced" by Hitler.

One last question to the Judge: Is Marion Marion Barry now vindicated?
