Fox News Andrew Napolitano wants to set free Oregon Christmas tree bomber. On last nights OReilly Factor, prominent judge and libertarian thinker Andrew Napolitano was on as a guest to discuss his controversial, to say the least, opinion on what to do with the 19-year-old Christmas tree bomber in Oregon. Somewhat surprisingly, the judge actually wants to set free the terrorist Mohamed Osman Mohamud because he argues that the US government coerced the lad into wanting to kill Americans at Oregons tree-lighting ceremony. However, the judge may actually be on the wrong side of the law on this very shocking issue since the Supreme Court has ruled that coercion or entrapment is not a valid defense if the accused wanted to commit the crime.

Wife had the day off yesterday and had the TV on most of the time. Fox was airing adverts for this show last night. I had the feeling Napolitano was going to argue this. The implication was there. That’s one reason why I put little stock in what he has to say...

As soon as the perp dialed the cell phone to attempt to blow up the charges, it sealed his guilt, AFAIC. If the FBI hadn’t brought him into their plot, he would have found an actual one that could have killed Americans.
I usually like the Judge, but I saw the program and was screaming at him. He is off-base by saying that the FBI entrapped the guy.
A similar case in Dallas concluded this Fall. A young Muslim who wanted to blow up a skyscraper full of people during the working hours in downtown Dallas. FBI learned about him and, over time, helped him load a van with “dummy” explosives. The van was driven under the building to the parking garage. The Muzzie was given a cell phone and a number to call to detonate the explosives. The phone call went to an FBI agent. The guy was arrested. ....He was convicted on all counts, EVEN in the very liberal city of Dallas! No findings that the FBI coerced the guy to proceed. .....There was little national news coverage of this incident, but for some reason they have chosen to give wide coverage to this latest attempt by a Muzzie in Washington.

No lawyer here, but a lawyer did explain to me once that entrapment means the govt goads you to do something illegal that you otherwise would not do.
If what I have read to date is accurate, I have trouble with the judge’s reasoning on this one. This dude was not encouraged to do something he would not have done absent law enforcement people.
You do not have to coerce Solamis to kill or destroy. Al Waleed’s Fox along with Al Waleehs CNN and Disney plus the other 3 networks he has deals and joint venture partners ships.

In this case, give him 30 days, turn him loose ... and just leave the poor kid alone. He just had a bad childhood, he'll be ok now that we've talked to him a little.

The Deloreon case is a prime example. The Feds knew he was desperate for money to keep his car company alive, and approached him to finance a drug deal, telling him that he would make millions, and save his business. He lost the company, but was cleared of the charges.
That was classic entrapment.

My question is why in the hell did we import all these Somalis in the first place? They tried their best to kill our guys back in the 90’s and we reward them with a free pass to the US? How F’d up is that? I’m still ticked that they were celebrating in the streets in Seattle after 9/11 happened. Right there we should have pack the lot up and sent them home.

I like the judge’s hairline - one of the lowest in the biz.
I think he may be on the wrong side of this question. But I usually agree with him.

Exactly!!! I heard the whole explanation. He said they took this young man’s hatred for America and exploited it. They trained him how to make a bomb, set off bombs, ext.. Not that I don’t think this young man doesn’t have some serious issues, but, I understand what the Judge was saying.
