The "Vexatious Requestor Bill" is moving forward. The Office of Taxation wants to fine people who are labeled "vexatious requestors" and Fukino has said there are 4-6 people who are all set to be labeled this. I am certain I am one of them. Fukino is asking for "facilitated passage" of this bill.
The comment will have the link to the testimony by Fukino and the taxation dept.
It will also have a link to the latest addition to my blog - a post describing how the DOH falsified the e-mail communications record in order to frame me as a "vexatious requestor".
They are out for blood.
Well, Obama has been pretty good at presiding over the passage of various ex post facto laws.
But it does seem to me that what you describe would violate the basic rule of law, if they try to pass a new law to punish a “crime” that was committed before the law forbidding it was on the books.
In fact, ex post facto application of the law has been considered wrong ever since Magna Carta.
Perhaps they are pretending to clarify existing law. Still, I would think that the worst they could do would be to forbid any future “harrassment.”
I’m not a fan of the ACLU, but this is actually something that would be down their alley. Hawaii is opening themselves up for a court battle ... one that might finally force the original Obama birth records out into the public.

Get some legal representation that has not been involved with your cases so far.
Sounds like a bill of attainder now that it’s on record to be targeting only 4 to 6 people in the state.
You can also find some media allies here, point out the state is curtailing sunshine laws and FOIA laws in a tyrannical attempt to destroy the 1st amendment rights of the people and the professionals who want open and honest government. Someone on those islands will have interest piqued if they see that angle as a good headliner.

The thing of it is, they don’t have any laws saying how many requests you can make, whether you can ask for the same thing somebody else asked for already, whether you can associate with other people to reduce the number of requests necessary, whether you can appeal to the OIP if you are wrongly denied, etc. All the stuff I’ve done is legal. The whole determination is whether they are bothered by it.
In the instances where they gave answers that I was able to understand as conforming to the law I didn’t ask anything more about that. One person I know of has NEVER asked a SINGLE question about Obama. Her only requests have been for things they are required to have available and to make public.
This is entirely a punitive law - punishing people for the DOH folks feeling frazzled.
Well, they wouldn’t feel frazzled if they would just answer the stinkin’ questions as required by law. Jeesh.
The most they could do is attempt to stifle further actions under any new law, and the passage of such a law would indicate that they are hiding something.
Which, of course, they are.
I noticed the DOH mentioned states where they were getting mulitple requests. One was Arizona, so I’m wondering if that’s Linda Bentley, the reporter for the Sonoran Desert News who wrote about the selective service forms. The point is that this law would infringe on the freedom of the press. butter, you should look her up and send her a note. A little teamwork might be necessary.
I’m a legal moron. I don’t know any of the terminology and I’m actually not involved in any cases because I can’t afford an attorney to represent me. I’m also not from Hawaii, which is the big complaint they’ve made in newspaper articles. Their laws say that “any person” has access to their records, but they hate it that people outside Hawaii are asking for records.
But for them to be making these drastic moves it should put red flags up for everybody. You don’t get rid of your open records law in order to punish 4-6 people.
Anybody with ideas of what needs to happen, I’m all ears.
As ex post facto laws are not a problem they cannot frame or fine you for things you have already down under legislation they are just now passing.

What amazes me is the Takase argument that people are coordinating their UIPA requests. UIPA is supposed to be all about public interest, that’s why people are working together. Takase/Fukino want to punish the public for having a keen interest.
AND Takase believes that she is qualified to diagnose mental illness? This attitude is so over the top.
There are no solutions for you, Butter. I don’t believe any of the lawyers involved are on the level. I imagine none in Hawaii would represent a case like this... They’ve probably been forewarned/bullied.
They are clearly trying to intimidate us. They want us to give up. This is a gross abuse of power.
I very much disagree with Takase in her assessment that people are abusing the spirit of UIPA. I think she’s just shocked and upset that it’s a law that actually works FOR the people, instead of corrupt government officials like BHO.
BHO has been afforded every loophole in not being required to show his BC. The one law that works for the people and they CHANGE the law to suit corruption. It’s not a surprise, but it’s shocking none-the-less.
Wasn’t there something in some outdated document that used to mean something in this “nation” about a “right” to petition the rulers or dictators or something like that? I know it doesn’t mean anything anymore, as this story shows, esp after the rise of The One. Just asking for the history buffs, I’m sorry old dead white guy mythology buffs...

Indeed it is. The $2,000,000.00+ dollar question is...who in the judicial system would even consider hearing such a case. Unfortunately, I'm thinking that they would simply say that such a plaintiff has no standing.
They can't possibly handle the truth.
