Impeachable Offense--the 5th Amendment and 'Government Motors'
Columbia Conservative Examiner ^ | June 7, 2009 | Anthony G. Martin

Posted on 06/06/2009 10:38:49 PM PDT by Welshman007

With the government-imposed terms of bankruptcy for GM and Chrysler, Barack Obama has violated the 5th Amendment to the U.S. Constitution--a serious impeachable offense. Bond holders and investors were deprived of due process of law and were not justly compensated for their investment. Instead, the UAW was given .68 cents on the dollar, although they never invested a dime in the companies, and the investors only received .28 cents on the dollar for their multi-millions they pumped into the 2 automakers.

Couldn’t there be some kind of Class Action lawsuit?

I completely agree with this assessment. This is premeditated theft by color of authority.

So he points it out, clear as day that this is an impeachable offense...now what can we do about it?

Are we left with no outlet when Constitutional attorneys can’t make any headway on these issues.

_______________-

What do you mean by “color of authority”?

By the illegitimate authority of the government — e.g., they had no legal right to do what they did.

Can’t someone initiate some kind of legal action?

Basically, it means claiming to take action based on a ligitimate authority when that authority does not exist, or exceeds the legitimate authority.

An example I am dealing with personally is a case in which a person exercising judicial authority when there is no constitutional or other legal author for even the existence of the position he claims to occupy with the permission of a state supreme court.

I'd think a lawsuit by the disenfranchised bond holders would be in order. Methinks this is why the Democrats have recently (and in full panic) “suggested” that Obama “rethink” this plan ASAP.

"Couldn’t there be some kind of Class Action lawsuit?"

Against the Stalinists and their agents at Democrat Motors?

It's gonna take a miracle to pull that off, but I hope the shareholders can do it.

Our Republic really is becoming more and more divided into a "Americans vs. Communists" environment.

IF Memory serves, did the impeachment proceeding for Clinton begin in the Senate? If so, then we stand little chance with the sycophants in congress coming to this conclusion unless more democrats like Byrd and Hoyer start to crow about the number of czars AND the people who had personal funds invested in these companies start to pound on their state reps and let it be known if they do not do something about this they will be ushered out of a congressional job next election cycle. That could be a start.

Agreed, as a way to get rid of the @ssholes & put new bodies in the seats, but the impeachment would get rid of the POTUS want-to-be!

The 2nd Amendment provided the means to resist or punish tyrants....and to defend the Republic against all enemies, foreign or domestic.
