By the illegitimate authority of the government — e.g., they had no legal right to do what they did.

Basically, it means claiming to take action based on a ligitimate authority when that authority does not exist, or exceeds the legitimate authority.

An example I am dealing with personally is a case in which a person exercising judicial authority when there is no constitutional or other legal author for even the existence of the position he claims to occupy with the permission of a state supreme court.
