Perhaps more than anyone in Washington today, Theodore Olson knows the dangers of the path the Obama administration is traveling on the question of Bush-era terrorist interrogations.
It's not just that Olson is one of the nation's top lawyers and a former high-ranking Justice Department official. It's not even that his wife Barbara was among those killed by terrorists on September 11, 2001. The thing that makes Olson's perspective so valuable is that his life includes not only those experiences but also a keen perspective on the way Washington investigations can run amok.
In the 1980s, Olson was the subject of controversy over advice he had given, as the head of the Justice Department's Office of Legal Counsel, to President Reagan on a question of constitutional privileges. His position angered Democrats in Congress, and for his troubles, Olson became the target not only of Capitol Hill investigations but a long independent counsel probe. A politically charged issue that should never have been investigated in the first place turned into a years-long nightmare.
Does that sound familiar? It's happened many times, at the instigation of both Democrats and Republicans. (By the way, Olson was ultimately found to have done nothing wrong.)
Now, the president's decision to release confidential Justice Department memos on the "enhanced interrogation techniques" used on a small number of al-Qaeda operatives has again set the Washington investigation machine in motion.
"It seems irrational and incomprehensible to me," Olson told me this week. "They have started something they can't stop, now that it's out. And what conceivable good can it do?"

Lawyer Full Employment Act?
Oh, nonsense. These are show trials. Who needs silly things like evidence and due process when the verdicts have already been decided?
"Time to feed"
'Headline-of-the-day' ...
The Liberal-Progressives want Stalinist Show trials with cameras, confessions, and executions masked as suicides. They will not be pleased until President Bush is in the dock.
This is a blatant attempt to substitute UN "law" for American law. This has to stop now. Peter King is right that Republicans must oppose it with "nuclear" force.
Now we’re going to see all the “torture” pictures. When is the MSM going to release or find pictures of the blood from the World Trade Center bombings? All I ever saw were dazed and confused people walking around w/dust on them. What about airing some of those beheadings; that’s a scene you’ll never forget, and borders on torture as well!
We still miss you BHO.
Folks on this forum have seen me rail on illegal immigration for a long time. Most of my emphasis has been the biggest problem we have, the Mexican populous flooding into the U.S. without going through due process.
Another problem is the VISA overstay. Barbara Olson was a very bright woman. She was a model Conservative and defended it as well as anyone I have ever seen. She did so on the talking head shows. She handed the leftists their lunch all the time. I was very proud of her. Her loss touched me personally. I think back on her abilities often, and miss her.
A portion of the 09/11 perps were inside our nation, after their VISAs had expired. They were student VISA.
My thought was that we should trim those student VISAs considerably, and get things under control. Well, right now we have over 30,000 students here on VISA from Saudi Arabia. If only 1% of those VISAs result in those people staying beyond the time they should, 300 people will be roaming our nation at any given time. My guess is there are far more than that doing so.
Nineteen people attacked our nation on 09/11, and caused massive loss of life and damage.
Did we lean nothing?
I am off topic here. Ted Olson and his comments regarding torture investigations is an important topic, and I believe him to be right on target here.
I cannot pass a mention of Barbara without lamenting her loss, what contributed to it, and the people who facilitated it with their inattention to the control of our borders.
There is blood on the hands of our leaders. There will be a lot more, if we don’t make them get our borders under control.
More people are dying every day. More women are being raped very day. More children are being sexually abused and snuffed every day.
Political leaders, we are watching.
The Conservative Base launched the 2010 election at the Tea Parties. This is the Democrat response. They’ll hem and haw for a year then start the actual hearings in January when the campaign really starts.
This should be no surprise to anyone.
Whenever the left attains power, throughout history, it’s not enough to “win” - they must exterminate opposition.
And, yes, a “nuclear option” must be used, but don’t expect the GOP to BE that option. The “nuclear option” is separation, or secession, and reformation of America separate from the Marxists.
Obama appears to be a master of intimidation. And an enemy from within who strikes fear into the very heart of our judicial system. I don’t think this was really ever about prosecuting those involved with techniques used in the latest Afghani/Iraqi War, although it throws a bone to his leftist supporters who want it desperately. It’s about intimating our good lawyers. Conservative lawyers have been successful in training young lawyers how to think and govern according to conservative, small-government principles. The Federalist Society comes to mind, but there are think tanks as well who nourish these conservators of our founding principles. Obama wants them too afraid to continue giving their opinions... He is such a dangerous man.
Well, keeping it on the back burner until, say, October, 2012 comes to mind.
Lets face it. The last such commission, which investigated possible failures to investigate 9/11, was stacked full of left-wing stooges, even though President Bush was nominally in charge. It even included Jamie Gorelik, who may have been as guilty as anyone for what went wrong.
As a result, the report was essentially worthless—a lying coverup throwing blame in the wrong directions.
If it happens again, Obama will not be so kind. It really will be a Stalinist show trial.
As long as the borders are secured this time - because you know the welfare pimps and trust fund babies tired of high taxes will try to slither in.
They do it to their neighbor red states all the time. If we go to the trouble of seceding, the tards should have to sleep in the beds they’ve made for a change.
And since it should be utopia, I can’t imagine why they wouldn’t want to. </s
Yes, seriously, we have to keep the “blue state bleed” from happening.
Perhaps a few of us could get together with some experts in devising a test to keep out those of the ideology that led to this mess in the first place.
Of course, the absence of social programs will keep out most of them.
What kind of political traction do they expect to get out of this?
