After Supreme Court curtails federal power, Biden administration weakens clean water protections

The Biden administration weakened regulations protecting millions of acres of wetlands Tuesday, saying it had no choice after the Supreme Court sharply limited the federal government’s jurisdiction over them.

The rule would require that wetlands be more clearly connected to other waters like oceans and rivers, a policy shift that departs from a half-century of federal rules governing the nation’s waterways.

Environmental Protection Agency Administrator Michael Regan said the agency had no alternative after the Supreme Court sharply limited the federal government’s power to regulate wetlands that do not have a “continuous surface connection” to larger, regulated bodies of water.

Justices boosted property rights over concerns about clean water in a May ruling in favor of an Idaho couple who sought to build a house near a lake. Chantell and Michael Sackett had objected when federal officials required them to get a permit before filling part of the property with rocks and soil. […]

The court’s decision broke with a 2006 opinion by former Justice Anthony Kennedy that said wetlands were regulated if they had a “significant nexus” to larger bodies of water. That had been the standard for evaluating whether developers needed a permit before they could discharge into wetlands. Opponents had long said the standards was vague, hard to interpret and generally unworkable. …

The AP weeps because the federal government no longer has jurisdiction over some farmer’s drainage ditch.

It took three people to write this article. It sure would be nice if the EPA visited at least one of them, and declared their gutter pipes to be under federal control. Then throw in an FBI raid or two.

Yes, that would be nice.

As I read it, every puddle, beaver pond, momentary cascade and trickle, nationwide, is no longer automatically under the sole control of the Feds?

Good.

They try to regulate water that temporarily falls on fields as wetlands. They used it to the major extreme. This stops the insane tyranny fedgov was doing before.

You are, unfortunately, on the right track. Democrat cheating (which the GOPe doesn’t seem to care about) will eventually give us a succession of crazy D presidents. They will appoint crazy Justices.

The next thing you know, the EPA will have authority over that little puddle that last night’s rain put in your back yard.

America cleaned up industry and economy. It is an unjust burden foe the American people be subject to excessive taxation to support current government strangulation by legislation. Just as NATO needed to pony up their 3%, as does the world need to catch up.

USG should put tarrifs on imports from any country gaining economic advantages due to pollution. Simply calculate the cost to match the EPA standards enforced. A rate of 10x should force these products from our shores. 10x for pain and suffering.
