A curious thing happened in the Supreme Court budget hearing yesterday. Rep. Joe Serrano went on a long monologue about 'diversity' in the court and even said he would be glad when the day came, that a Puerto Rican could be president...to which Thomas replied that the court was avoiding that question. Nervous laughter ensues and the topic is quickly dropped. I'd like to know what my fellow FReepers think of the exchange.
It happens around the 1:13-1:14:10 mark in the video. It would be great if someone could isolate that exchange and put it on YouTube so everyone could hear it without sitting through the entire hearing.
Hmm, there is a requirement, 12th amendment that the Presidential and Vice Presidential candidates not be from the same state. (Actually the requirement is that an elector cannot vote for both a VP and Presidential candidate from the same state as themselves.) But I guess with someone from PR, or Guam for that matter, on the ticket, that would not be a problem, since they are not from the state as any elector.
An interesting question would arise if both candidates were from DC. DC is not a state, so could the DC electors vote for them, or not. Clearly the intent of the provision would be violated if they could, but not the letter.
The question of whether or not a Puerto Rican is qualified under Article II to run for,and serve as POTUS is a damned good one.
Based on the strange body of law known as "The Insular Cases," IMHO, the probable answer is "NO."

No argument there, unfortunately, it seems with Stephens imminent departure, the court will be headed in exactly the opposite direction from the brass ones. We shall see.
Note Thomas’s use of the word “evade” vs. “avoid.” He is very intelligent and very articulate, so I must assume he did this on purpose. I can’t tell for sure if he was joking about the subject matter or not, but as far as word usage, according to Encarta:
“avoid, evade, or elude?
All three words involve keeping away from a person or thing or keeping a person or thing away from you. The main difference between avoid and evade is that avoid is neutral in tone, whereas evade implies dishonesty or deception, or at least some sort of ulterior motive. If you avoid a responsibility, you take measures to prevent it from being necessary, whereas if you evade a responsibility you get out of it in an underhanded or deceitful way.”
Thomas meant that: If a KENYAN can be POTUS I guess a Puerto Rican can also.
That is what Justice Thomas meant when he said we are giving you MORE OPTIONS.
SCOTUS can't do anything UNLESS it is brought in front of them. They can’t file cases to hear or make rulings without having an issue brougth to them. Meaning they are powerless to initiate actions/filings their only power is to make rulings of issues brought to them.
I bet if Tim Turner brought an Eligibility Case as a Sovereign American he would have STANDING and it Would be Heard.

Of course it’s lame, but I don’t blame Thomas for it. I blame Obama,his henchmen and lapdogs. I actually rather appreciate the fact that Thomas had the spine to mention the truth. The courts ARE EVADING THIS ISSUE...BIG TIME!
