Six weeks ago, Senator Mark Kelly — and five other members of Congress — released a reckless and seditious video that was clearly intended to undermine good order and military discipline. As a retired Navy Captain who is still receiving a military pension, Captain Kelly knows he is still accountable to military justice. And the Department of War — and the American people — expect justice.

Therefore, in response to Senator Mark Kelly’s seditious statements — and his pattern of reckless misconduct — the Department of War is taking administrative action against Captain Mark E. Kelly, USN (Ret). The department has initiated retirement grade determination proceedings under 10 U.S.C. § 1370(f), with reduction in his retired grade resulting in a corresponding reduction in retired pay.

To ensure this action, the Secretary of War has also issued a formal Letter of Censure, which outlines the totality of Captain (for now) Kelly’s reckless misconduct. This Censure is a necessary process step, and will be placed in Captain Kelly’s official and permanent military personnel file.

Captain Kelly has been provided notice of the basis for this action and has thirty days to submit a response. The retirement grade determination process directed by Secretary Hegseth will be completed within forty five days.

Captain Kelly’s status as a sitting United States Senator does not exempt him from accountability, and further violations could result in further action.

These actions are based on Captain Kelly's public statements from June through December 2025 in which he characterized lawful military operations as illegal and counseled members of the Armed Forces to refuse lawful orders. This conduct was seditious in nature and violated Articles 133 and 134 of the Uniform Code of Military Justice, to which Captain Kelly remains subject as a retired officer receiving pay.

I have very little expectation that anything will happen to Kelly or any of the other traitors.
But anything that can be done to tarnish their careers would be something.

Those are pretty strongly worded notices for a seditious video. Still accountable to military justice? What’s that? How about the other seditious SCUMBAGS? Are they accountable to anyone?

Absolutely. I think trying to prosecute a sitting U.S. Senator and retired member of the military for making an accurate recitation of U.S. military law is a laughably bad case. I've said repeatedly that Hegseth should have him charged under the UCMJ if he actually believes him to have violated it.

But he won't.

It would be funny if he did, though, so I'm definitely rooting for it.

Every member of the military has a right to refuse to obey an order they believe to be unlawful. They are still subject to the UCMJ. Choice is life in prison for murder or refusal to obey a lawful order( 4 or way less years) in prison?
Your choice.

The implications by Kelly and other democrat goons was that ‘THEY’ would have Nuremberg style trials for anyone following Trump’s orders.

It was sick, twisted and uncalled for. Even the dem’s press bimbos and pretentious ‘men’ asked if there were any unlawful orders being made by Trump or the Department of War - and NONE Of these democrat goons were able to come up with even one...

The purpose of the sick drama was to call for chaos in our military - to ‘imply’ there were unlawful orders being given.

Notice in the Venezuela action there were no reports of hesitant members of the force deciding to refuse to take that poor man Maduro into custody without Congressional pre-authorization.

That's the inference you apparently drew from what they said, but that's not what they actually said. What they said was literally almost verbatim from basic military law. They knew where the line was, and they didn't cross it. Even if you think you know what they "really meant".

My nephew (USMC vet) says “all retired officers are in the “retired reserve”. They are reservists and could even be activated in time of war. So still accountable to UCMJ.

It was a very carefully crafted, but suggestive posting, including threatening the service members if they follow an unlawful order. It was encouraging members to make a stink about their orders so democrats could make political hay out of it. In effect, undermining the authority of their superiors.
