Woman Sues Porn Sites After Son Finds Her Old Laptop, Uses It to Watch Porn

A woman from Kansas has sued a number of porn websites after her teenage son found her old laptop in a closet and used it to visit the explicit sites. According to the lawsuit, the sites in question failed to institute appropriate guardrails to keep young users away from the adult content.

404 Media originally reported on the litigation, which was filed with the help of The National Center on Sexual Exploitation Law Center (NCOSE), an organization that focuses on a variety of sex crimes, including sex trafficking and child sexual abuse material. The suit lists as defendants Chaturbate.com, Jerkmate.com, Titan Websites, and Techpump Solutions (also known as Superporn.com). A statement from NCOSE explains the mother’s grievances thusly:

Q.R. is a 14-year-old minor child who resides in Kansas with his mother, Jane Doe. Jane Doe was vigilant in monitoring Q.R.’s devices to prevent his exposure to harmful material during this important developmental stage of his life. However, on August 12, 2024, Q.R. found an old laptop that was stored forgotten in a closet. Unfortunately for Q.R., it was still in working condition. Q.R., using this old laptop, was able to access the internet and began searching for hardcore pornography.

The lawsuit hinges on the claim that the sites should have instituted age-verification mechanisms to comply with a recently passed Kansas law that mandates authentication for adult sites. A statement from the NCOSE claims that the litigation represents the “first lawsuits filed in the U.S. that challenge alleged violators of age verification laws.”

“It is unreasonably dangerous for these pornography websites to provide this product which they know is harmful to children, that children are drawn to access, and do access, without employing age verification as required by Kansas law. Our plaintiff deserves every measure of justice,” a statement from the NCOSE says.

Gizmodo reached out to the defendants, with the exception of Titan Websites, as it wasn’t immediately clear how to contact the company.

The NCOSE’s website shows it has also assisted with lawsuits against XVideos, another prominent porn site, as well as against Twitter, which it accuses of breaking a federal sex trafficking statute.

GOP Senator Introduces Bill to Make All Porn a Federal Crime, Following Project 2025 Playbook

The modern anti-porn movement has popped up in mostly conservative states and has sought to highlight the harmful psychological impact that pornography may have on young people. Over the past decade, more than a dozen states have passed age-verification laws designed to curb youth access to porn, much of which is still being challenged in court. It’s unclear how effective these laws can actually be, since using a VPN should presumably allow a user to pretend as if they are accessing the websites from a location that is unregulated by such laws.

I guess if he would have found her old loaded firearm stashed away in her closet and used it to kill someone she would have sued all the firearm and ammo manufacturers for gross negligence.

> Yeah you see a checkbox that says “Yes, I’m over 18 years old”, what do you think any kid will do. The Leisure Suit Larry games would ask trivia questions that anyone under 18 most likely wouldn’t be able to answer.

I know it's not popular to say this on FR, but if I were a 14-yr old boy and I found an unsecured laptop, I would do exactly the same thing. Of course, when I was that age in 1966, I did the equivalent: I stumbled upon my Dad's collection of Playboy magazines, stashed in a hidden drawer in his Man Cave.

As to the trivia questions, well geez, that's what Google is for, right?

I'm going to sue Jack Daniel's because my kid found my whiskey stash and got drunk.

(sarcasm, because I hate hard liquor AND don't have any kids.)

I remember what it was like being a teenager back in the ‘80s. It seems strange to me that when you are basically a walking hormone you are not allowed to see girly pix. Fortunately my Dad left his old Playboys in the attic for my brothers and I to find. Thanks Dad! Of course today’s kids have the internet. Teenagers are not little children, they are grown ups in training and should be treated as such.

You’d have to have a time limit, so you wouldn’t have enough time to look it up.

LOL
The hypocrisy about porn is so bad.

I had similar experiences when I was a younger adolescent. Almost all of my friends found their Dad’s magazine stash, or even were able to procure some for themselves and had to hide their own stash from their Mom. Some Mom’s didn’t even care.

If a kid full of hormones isn’t going to find porn one way or another, they are going to find something racey on TV or even resort to using their imagination. I may make some people uneasy to think about but it’s just a normal part of growing up.
Isolation doesn’t work. Children don’t become asexual saintly cherubs just because you kept them from seeing sexual things.

So the kid lied and said he was over 18 to access the sites, when will he be prosecuted for lack of candor?

More of the “debate is over.” Thanks Gore-

Your argument follows the same logic as the anti-gun folks make when trying to ban “assault weapons.”

These high power military weapons were not around when the founding fathers wrote the Constitution and were never intended to be in the hands of normal people. The founding fathers had ZERO understanding of assault weapons... bla bla bla.

What constitutes “pornography” is a highly culturally relative idea, not unlike what an “assault weapon” is to some folks, and these ideas change over time (a lot).

They were making naked statues and paintings when the founding fathers were around. Was that pornography? Are you telling me there weren't people offended even back then by some of that?

This quickly degenerates into where “someone feels” they know what is right and wrong an think they have a right to impose their morality onto others.

No, that's not what the Constitution is about. In fact, the US Constitution is about free speech and the right to expression, the antithesis of what you're trying to argue.

This isn't anything new. It's the same story over and over, every decade, nothing new: https://www.youtube.com/watch?v=t0T8uRXYEwA

In the 1990s: https://www.yahoo.com/entertainment/2-live-crew-obscenity-trial-213607638.html) It's an ongoing story that was around in the 90s, 80s, 70s, 1880s, 1780s... no kidding. Back then, Gore and his wife chimed in on this too, of course (these are easy ways to score some political capital with some): https://www.mentalfloss.com/posts/tipper-gore-fought-against-80s-rock-music-parental-advisory

Your rights end where you begin to infringe on someone else’s rights (The Wendell Holmes argument): https://quoteinvestigator.com/2011/10/15/liberty-fist-nose/

If a parent allows a kid physical access to a computer, the kid isn't taught to stay away from those sites, the laptop has no password protection, no firewalls to block such sites are in place, that's on the parent, not some porn site.

One point to remember: in the past the teenagers were not only "walking hormones" but they had full time jobs and married a lot earlier than they do now. I'm cool with the suggestion that teenagers be treated as "grown ups in training", as long as we're talking about at least most of the "training" time being dedicated to taking care of responsibilities, not porn and video games.

For example: My grandfather married and was getting it on at a lot earlier than I did ... but he also worked full time at the steel plant at the same age that I started my first job working part time at a grocery store (not counting earlier money I made cutting my elder neighbors' yards). He was man enough to make ends meet at an earlier age than I was, and by extension, one could argue, mature enough to have sex at an earlier age.

But in the modern world it's the opposite. It's expected for kids to be sexual long before they learn to be responsible. I'm not ready to agree to that.

Contrary to any libertarians here, and contrary to recent Supreme Court rulings, pornography has no Constitutional rights.

Intellectual nonsense. The same founders who write and ratified the Constitution, wrote, passed, and enforced laws that banned indecent materials. QED. The Constitution means what the people who created it meant it to mean, not what modern people want it to mean.
