After vowing for years that he would not pardon his son, Hunter, Joe Biden on Sunday signed a “full and unconditional pardon” for all offenses he “may have committed” between 2014 and 2024, claiming that Hunter was “singled out only because he is my son.”
For those offenses against the United States which he has committed or may have committed or taken part in during the period from January 1, 2014 through December 1, 2024, including but not limited to all offenses charged or prosecuted (including any that have resulted in convictions) by Special Counsel David C. Weiss in Docket No. 1:23-cr-00061-MN in the United States District Court for the District of Delaware and Docket No. 2:23-CR-00599-MCS-1 in the United States District Court for the Central District of California.
Hunter Biden joined the board of the notoriously corrupt energy firm Burisma Holdings in the spring of 2014 at a reported salary of $50,000 a month, even though he had little experience in the energy sector. Almost immediately, an adviser to the board of Burisma, started emailing Hunter, asking him for “advice on how you could use your influence” on the company’s behalf.
In an unpublicized meeting about a year later, the younger Biden introduced his father—then the vice president—to Vadym Pozharskyi, a top executive at Burisma, according to emails found on his infamous laptop.
Hunter Biden was only convicted of federal gun charges and federal tax evasion charges earlier this year. The gun and tax evasion charges came only after U.S. District Judge Maryellen Noreika rejected the “sweetheart” plea deal between Delaware US attorney David Weiss and the defendant’s attorneys in July 2023. Noreika had said she was concerned about the language in the diversion agreement, which included “details about not prosecuting Biden for tax crimes in the future,” amid an ongoing investigation.
In a White House statement, the outgoing lame duck claimed that his son was “selectively, and unfairly, prosecuted.”
Without aggravating factors like use in a crime, multiple purchases, or buying a weapon as a straw purchaser, people are almost never brought to trial on felony charges solely for how they filled out a gun form. Those who were late paying their taxes because of serious addictions, but paid them back subsequently with interest and penalties, are typically given non-criminal resolutions. It is clear that Hunter was treated differently.
The charges in his cases came about only after several of my political opponents in Congress instigated them to attack me and oppose my election. Then, a carefully negotiated plea deal, agreed to by the Department of Justice, unraveled in the court room – with a number of my political opponents in Congress taking credit for bringing political pressure on the process. Had the plea deal held, it would have been a fair, reasonable resolution of Hunter’s cases.
No reasonable person who looks at the facts of Hunter’s cases can reach any other conclusion than Hunter was singled out only because he is my son – and that is wrong. There has been an effort to break Hunter – who has been five and a half years sober, even in the face of unrelenting attacks and selective prosecution. In trying to break Hunter, they’ve tried to break me – and there’s no reason to believe it will stop here. Enough is enough.
The notoriously corrupt Biden, who launched his 2020 campaign on the “very fine people on both sides” Charlottesville lie, added risibly: “For my entire career I have followed a simple principle: just tell the American people the truth.”
They’ll be fair-minded. Here’s the truth: I believe in the justice system, but as I have wrestled with this, I also believe raw politics has infected this process and it led to a miscarriage of justice – and once I made this decision this weekend, there was no sense in delaying it further. I hope Americans will understand why a father and a President would come to this decision.
Hunter was convicted in June for “lying on a federal screening form about his drug use, lying to a gun dealer and possessing the gun.” In September, he was convicted on three felony tax offenses and six misdemeanor tax offenses. The younger Biden was facing up to 25 years in prison for the gun violations, and another 17 years for the tax offenses.
More serious charges related to money laundering, bribery, and operating as an unregistered foreign agent of corrupt and adversarial foreign governments, all of which were tied to the Biden clan’s corrupt influence-peddling operation, were never brought against the first son.
President-Elect Donald Trump reacted to the News on Truth Social.
“Does the Pardon given by Joe to Hunter include the J-6 Hostages, who have now been imprisoned for years? Such an abuse and miscarriage of Justice!” Trump wrote.
Senator Josh Hawley (R-Mo.) posted on X that the Biden regime was “the most lawless administration in history.”
“Never forget: while Hunter was selling access to “the big guy,” Joe Biden’s administration sent SWAT teams to the homes of prolifers; recruited spies in Catholic parishes; treated parents as domestic terrorists; and prosecuted Trump. The most lawless administration in history,” Hawley wrote.
“I’m shocked Pres Biden pardoned his son Hunter bc he said many many times he wouldn’t & I believed him Shame on me,” Senator Chuck Grassley posted on X Sunday evening.
Hunter is a drug addicted pedophile. He will commit crimes after 12/1/2024 when he’s fair game for any prosecutor. He better stay in blue states from now on and even then daddy won’t have much clout anymore.
The Constitution gives the President of the United States broad pardoning power, with very few limitations.

The U.S. Constitution states, "The President … shall have Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment." (U.S. Const., art. II, § 2, cl. 1.) This language gives the president broad pardoning power, with very few limitations. (Schick v. Reed, 419 U.S. 256 (1974).) Moreover, the pardon power is the president's alone—the president's decision to grant a pardon cannot be overturned by Congress or the courts.
Presidential Pardon Power and Limits
The language in the Constitution highlights just two limits to the presidential pardon power. The president's authority extends only to offenses against the United States (federal crimes), meaning state crimes are beyond the president's control. And the president cannot circumvent Congress' power of impeachment. Beyond this, the president's power is restrained only within other constitutional limits. Let's explore these provisions further.
Federal vs. State Crimes
The President's power to pardon individuals extends only to federal—not state—crimes. Federal crimes generally involve federal or national issues, such as federal tax fraud, immigration violations, counterfeiting U.S. currency, and wire fraud. Most crimes are actually prosecuted at the state level, such as murder, sexual assault, and theft (as long as the crime doesn't cross state lines, at which points it becomes a federal crime). The president does not have the authority to pardon state offenses—that power is reserved for state governors. (Because state prosecutions are beyond the reach of presidential pardons, they can serve as an indirect check on the presidential pardon power.)
There are two (three actually - 2 in N.Y. 1 in Georgia) open state lawfare issues currently hanging over Trump's head. Time to up the ante. If nothing else, discussing the merits make make a difference as well. they cannot get away with the lawfare they have engaged in, for they will just do them again when they get back in power.
Trump would have no direct involvement in them whatsoever.

If Trump pardoned Don Jr for so much as a parking ticket there would be blood in the streets. The media would rend its clothes and gnashing its teeth. Congress would bleat in unison that “no one is above the law”. None of this goes away on its own.

Since Hunter is pardoned, he now cannot use the fifth amendment for cover. He must now disclose his actions and provide all documents related to his actions. Should he refuse or lie, that will be after the limits of the pardon and would create new crimes.
