Trump confirms plans to use military to deport migrants after declaring national emergency

President-elect Donald Trump confirmed Monday he would declare a “national emergency” to deport illegal migrants using “military assets” once he steps back into office early next year.

Trump made the statement on Truth Social, responding “TRUE!!!” to a post from Judicial Watch’s Tom Fitton citing reports he would do so.

“GOOD NEWS: Reports are the incoming @RealDonaldTrump administration prepared to declare a national emergency and will use military assets to reverse the Biden invasion through a mass deportation program,” Fitton wrote on the social media platform.

Trump has vowed to enact the largest deportation in history, starting when he takes the oath of office Jan. 20.

We don’t have militias. We have a standing military.

The military does not have law enforcement authority, by design and for good reasons.

10 U.S.C. § 252. Use of militia and armed forces to enforce Federal authority

Whenever the President considers that unlawful obstructions, combinations, or assemblages, or rebellion against the authority of the United States, make it impracticable to enforce the laws of the United States in any State by the ordinary course of judicial proceedings, he may call into Federal service such of the militia of any State, and use such of the armed forces, as he considers necessary to enforce those laws or to suppress the rebellion.


First Trump has to invoke §254 and order all illegals to leave in a certain timeframe. When the clock runs out, he can sick the active duty military on those who remain.

Interesting how now we’re supposed to accept federal power over states rights, and in the most extreme way possible. Active military units on our streets.

Got to drop the whole constitutional protectors, states rights, republic and freedom slogans with all that’s going on now.

Trump has plenty of leverage enshrined in law to use against countries that don’t accept their nationals back. One big one is shutting off all visas to enter the US by their nationals. It has a major impact economically as well as causing problems for their governments.

The Immigration and Nationality Act provides that, “upon notification by the Attorney General [now by the Secretary of Homeland Security], that a ‘foreign country denies or . . . delays accepting an alien . . . the Secretary of State shall . . . discontinue granting . . . visas . . . to citizens, subjects, nationals and residents of that country’ until the country accepts the alien.”

agreed, why give the plan on how you will do it. Just do it and be done with it. That said, deport them where? You know there home countries will not take them back.

Execute violent criminal illegals whose home countries would not take them back on live TV or a website. Then withhold aid to those countries--although that may not work now that china will be cozying up to those countries and they have more attractive money than we have currently.

You can get around the Posse Comitatus Act by embedding LEO and BP in with the regular army. The army detains and the BP makes the official arrest. It all works out.

Sent troops to disband the WW1 bonus army veterans.

Roosevelt calls out National Guard to remove Sewell Avery from Montgomery Wards and orders Sec. of War to seize Monkey Wards plants all over the nation - this was during WW2 and that was used as his excuse...interference into the war effort.

Eisenhower sent 101st Airborne to Little Rock in 1957...but he first invoked the Insurrection Act.

Not true. Natl Guard is the militia, along with other state militias. They are under a different Title and have different authorities while under state authority.
