‘No one should have to go through this’: Single mom in NC had to take Airbnb guests to court to get them out of her property — 2 ways to invest in real estate without the stress

A single mom in Durham, N.C. is finally getting her home back after squatters took it over.

Two people booked Farzana Rahman's two-bed, two-bath property via Airbnb for seven months. They then refused to leave when their stay was up in May 2024, claiming they're "legal residents" of the home.

Rahman ended up taking them to court to get her property back. But after they didn't show up to the hearing, the judge sided with Rahman and issued an eviction order. The Durham Sheriff's County Office served it to the guests on July 3, 2024.

Rahman changed the locks and hopes this ordeal is over, according to an update from ABC 11/WTVD.

“This is my place. I’m counting on this income. My son is in college [and] I’m a single parent,” Rahman told ABC11/WTVD before the hearing. She added that the eviction process was “wasting my time, it’s wasting my energy [and] it’s stressing me out.”

"No one should have to go through this. You would expect that people would understand rules and follow them, but it's just not the case in this instance," Rahman's assistant Jane Miller told the television station.....

Her guests paid what they owed through the Airbnb platform, but when her cleaner went to the property after the checkout time, the couple had not moved out and they told the cleaner not to return. When Rahman visited the property the next day with the police, she found a hand-written note stuck to the front door.

It read: “No trespassing. We will vacate the property when you have filed the proper paperwork with the civil magistrate for an eviction for we are legal residents of this home. If you try to enter, we will press charges for violation of expectation of privacy.”

In a few years I'll be moving out of my primary home, as it's waterfront making it an Airbnb is a consideration, also have and option of rental as I don't really want to give up the property. Both these options entail risks like above and I will not be living near the property.

I'll probably just sell to avoid future issues.

Well, that was nice of the “judge”

Sarcasm aside, it is really stressful to go before a “judge” these days. Many times they are accomplices to the criminals. What are they getting out of it? Probably their ideological goal, which is to tear the country down and rebuild it into a communist utopia where the judiciary is an organ of the state and to be feared and “respected”.

Anyone who thinks real estate is a great investment opportunity should just invest in a REIT. I am working with a client right now who is repositioning assets in retirement, and our first order of business is to sell off the real estate.

If that was my house, they’d be out in 24 hrs or less. “Expectation of privacy”, my backside. First, their legal claim: BS. I would just as well beat them senseless and claim they’re lying about it as there would be no witnesses. My claim is just as valid as theirs. Face it. Our society has fallen. We have to fix things ourselves.

Under current law you can sell it as your primary home. If you rent it or turn it into a BNB the taxes will eat it up.

The first time they left the property empty, I would go back into the house, and if they came back they would never be heard from again. Any assets they had along with their vehicle would likewise disappear.

Real estate can be a good investment in certain circumstances but it requires time and effort, the ability to invest without the immediate benefit of liquidity, and an understanding of tax implications.

As you may know, there are hundreds of publicly traded REITs that invest in all manner of properties. Its important to understand what their individual focus is. That said, if interest rates decline it could potentially benefit REITs in terms of rising share values. But again, its imperative to understand what they invest in and how they are valued (i.e., FFO/AFFO). Also need to be aware of related tax issues, one of which could change in the U.S. next year.

The owner was fortunate to have them evicted as fast as possible. It only took about 6 weeks and the article doesn’t mention any damage to the house..

If your property is located in Florida - you’re fine. The policy on squatters is: call the cops and within a few hours they’ll remove them. No lawyers needed, no eviction costs - just call the cops.

If you live in a blue hellhole state plan on spending months, maybe a year or two getting the squatter out - and spending thousands of dollars.

So, is your property in a blue or red state?

We had a similar situation 40 years ago in Santa Cruz County. It took close to six months to evict the squatter even though he had fled after three months!
