A federal judge said on Monday that he will dismiss Sarah Palin’s libel case against The New York Times, concluding that Palin’s lawyers had failed to show the publication acted with actual malice.

Sure, the NYT blamed Palin for the shooting death of a 9 year old girl with no support for the assertion whatsoever.

But they did so with love.

Why is this being released before the jury has even returned their verdict. Talk about jury tampering. You know someone has gotten a message to the jury about this.

Then why did he assign a jury? My God have we really lost this nation to the black robes? Has our nation completely dissolved into lunacy and injustice. Then I don’t want any part of this nation... is becoming obvious that Americans have no rights anymore!

If I ever serve on a jury and the judge dismisses the case after we sit through the trial and reach a verdict, I can assure you that this would be the last time I ever show up for jury duty.

Because, as the judge stated, this case is extremely likely to go to the appeals court, and they would benefit from knowing how the jury voted.

This is especially true if the jury finds differently than the judge.

He had already dismissed the case once, for the exact same reason. They appealed and won and it was sent back to the Lower court and Raken. So, he had the trial and is just doubling down on stupid.

A judge is a very powerful person in our system. They can overturn or toss stuff out as the deem appropriate.

Juries are for show. Judges can override anything a jury does with one exception. judge cannot impose a verdict of guilty in case a jury returns not guilty, in a criminal trial. In that case the judge can order a mistrial and retrial unil a jury delivers the verdict the judge wants.

I sat on a jury once for a full day of hearing the case. When we reconvened on the second morning, the judge came out and tossed the case because of something that the public defender had brought to his attention. He explained it to us. We never went to deliberations though.

We live in strange times ,My FRiend. She cannot be allowed to prevail. The United States is the 1930s Germany. And we are the Jews. But the Police and Military is on our side. From the first day I was on Free Republic. That has been Free Republic gospel. But if the Police are on our side, Why is the Washington, D.C. jail full of Patriots for exercising their Constitutional Rights?

“On the other hand,” said Rakoff, “this is the kind of case that will inevitably go up on appeal and the court of appeals will greatly benefit from knowing how the jury decided.”

“So, for example, if I were to dismiss the case as a matter of law for failure to prove an essential element and the jury were to decide the contrary,” he said, “then on appeal, the court of appeals wouldn’t have to send it back for a new trial. They could reinstate the verdict.”
