ACB has not ruled in favor of any vaccine mandates. The Indiana University case where she weighed in on an emergency order on a writ of injunction. It was not a lawsuit on the merits of vaccine merits.
The recent case on Maine’s healthcare workers was the same situation. It was a writ of injunction. She sided with the 5 other justices. Only Gorsuch, Alito and Thomas voted for the injunction. This case was a bit of a surprise because this request for an injunction was over Maine not allowing religious exemptions.
That means Roberts and Kavanaugh were in the same camp as as the liberals. No surprise on Roberts. It should be a surprise on Kavanaugh. He is not the constitutional conservative everyone seems to believe he is. His opinions on DC court should have been the red flag. He has moderate rulings like the justice he replaced. Kennedy was no Thomas. ACB doesn’t have enough judicial rulings after being on the district court of only less than 3 years to have made any evaluation on her judicial philosophy. Just because she was a clerk for Scalia doesn’t mean anything. She even said at her SC confirmation that she was her own person and was not going to be a female version of Scalia.
As far as this vaccine mandate from OSHA this is a completely different set of circumstances than the writ of injunctions. Those were private or state issues. This is the federal government using the Dept of Labor to institute a public health policy.
What will be one of the points brought up is the role of OSHA. Does an agency that exists to make sure ladders, guardrails and proper ventilation exists to protect a person while they are at their place of employment from workplace hazards have the authority to make a vaccine mandate. Of course not, Covid exists outside the workplace.
Another issue will be does a virus actually qualify as a hazardous substance or material which is the qualifier for an Emergency Temporary Standard. No it doesn’t. The arguments are going to be these employees have been working without a vaccine for 20 months and their wasn’t people dying at alarming rates. Another point that will be made is if this was thought of as a true emergency then why did the Biden administration wait 10 months to institute the rule. They also shot themselves in the foot by not having the ruling go into effect until January 4, 2022. That doesn’t fit an emergency either. Ron Klan added fuel the the lawsuit against the constitutionality of the ETS. He retweeted a reporter who said the use of OSHA was a good way to work around the constitution. Klan gave away the game.
The fact the federal government doesn’t have plenary authority that OHSA is claiming it has. Plenary power defined as wide-ranging, broadly construed, and often limitless for all practical purposes. The CDC tried to claim this in the SC case over their eviction moratorium that Biden forced them to issue after he said it was unconstitutional. The SC slapped back the CDC’s claim that they plenary power. I’m hoping this case on the OSHA driven vaccine mandate actually makes the Court strike down Chevon. That case was a bad decision that gave deference to the administrative agencies because they have the experts. We have seen the “experts” in full display during the pandemic.
The line of attack will be the federal government doesn’t have police power to enforce the mandate. Who will they send to make sure businesses are complying? The FBI or Marshals? OSHA certainly don’t have enough inspectors. They can’t enlist each states’s law enforcement. The Grabel test will be brought up from a 2005 SC decision. Also the constitutional question of does the mandate violate the Commerce Clause which only allows for regulations on interstate business. By and large the majority of businesses only are operating in a state. A question I’d like a lawyer to bring up is how does Biden’s OSHA department get to regulate international businesses. There are companies that are based in the US but have offices in other countries. How does OSHA’s authority extend to overseas.
In the 50 years OSHA has issued 9 ETS 6 have been challenged in court and 5 have been lost including one on asbestos. Each lawsuit that has and will be filed will take different lines of challenges to the ETS and its going to be fun listening to these oral arguments as the federal lawyers for OSHA try to answer all of these questions and have their a$$es handed to them for attempting such nonsense.

As I understand it, this sort of rule making by an administrative agency can be challenged directly in a Court of Appeals. I understand emergency OSHA rules are seriously frowned upon by the Courts, including the USSC.
An emergency rule side steps all the procedures and protections that are required in an agency making a new rule.
The Fifth Circuit covers Texas, Louisiana and Mississippi.
Do not be shocked to see similar orders from other Circuits in the coming days.
