proposal: presidential resignation + emergency special runoff harris-pence election
me | 2020-12-02 | me

Posted on 12/02/2020 9:55:08 PM PST by SteveH

all other alternatives to an emergency special election seem to end in some form of violence or permanent dislocation of one main party or the other.

a re-election would be fine but suffers from the flaw that it invites a repeat in the forseeable future simply by the precedent that it sets.

holding an emergency election between the two top second tier contestants is not ideal but there is no ideal alternative. this alternative might be the fairest among the hobbesian universe of unequally unfair choices that do not ultimately involve a government collapse.

if the two major parties agree, emergency legislation could be passed in time for a short campaign, a one day election, a foreshortened but otherwise normal electoral college process, and an inauguration by january 20.

trump and biden negotiate and agree for the benefit of the country to sit this one out and let their seconds battle peacefully for the presidency. it is not a re-co and so forms an generally unpalatable precedent for all future parties in all future elections. there will be less temptation to repeat this emergency election, and the temptation to set a vanilla repeat election which would lead to an unwise precedent is removed.

major parties don't have to agree on much except for the situation to be an emergency requiring extraordinary measures to recover from the emergency. if there is not enough time, then the inauguration and other deadlines could be moved forwards by a couple of months, by mutual agreement.

Pres Trump fights on. Alone or with his voters. He does not quit for the convenience of the commie dem party and the No Trumper republicans. We are with him whatever he decides to do. Pres Trump is a man of honor and does not take his oath as President lightly. He won this election with hard work and deserves to continue his, and our, battle for preservation of this Republic.He has my gratitude for all that he has done for all Americans. God bless him and his family and keep them all safe.

“if the alternative is insurrection or worse”

You don’t think we already have an insurrection? They are only quiet because the media is ignoring them and they think they have won.

If your solution to avoiding “insurrection or worse” is to surrender, you are a fool and a coward.

granted some of the democratic leadership is corrupt. if not the leadership, then the effective leadership consisting of the guys behind the curtain.

a proposal such as this could have many minor variants. however, a proposal such as this would get nowhere unless the democrats are willing as a political unit to take the first step of recognizing that a problem exists. perhaps that is the point of these hearings, to help America and in particular the democrat voting public (who i model as not having been a party to the cheating) come to the realization that cheating occurred and that it is immoral to benefit from any such cheating.

if the democratic voting public does not come to that realization then the remainder of the proposal falls on deaf ears and would get nowhere (of course).

it seems rational to explain an existing unanticipated problem to a person and to suggest that the person can help with the solution the problem with a bit of extra work. this is in a sense goodwill or civility. the usa was built on goodwill and civility. now we will get to see if we still have these qualities.

Re the 14th

Government by Judiciary: The Transformation of the Fourteenth Amendment

By Raoul Berger

From one of the comments at Amazon:

“Berger reveals why I had so much trouble [in law school] - it was all a crock they taught me! Law school teaches “unconstitutional law” - ie what the “justices’ do - not what they are supposed to do under our Constitution. Berger makes that crystal clear.”

It’s simply unconstitutional. The courts, SCOTUS in particular, can only rule that the state legislatures need to do their job as prescribed in Article II of the Constitution. Your idea is never going to be used, nor would it solve the problem.

by insurrection i meant physical insurrection. for example something similar to kansas around 1860.

i did not say surrender. i said consider all ideas to avoid violence. there’s nothing wrong or cowardly about that imho. you seem somewhat casual with your choice of words sir, bless your heart. i wonder if you are in the habit on person and if so whether you still have any front teeth left.

i’m going to extend to you the courtesy of a doubt that you did not mean what you said to me. i cannot imagine that you would say it to my face. consider that we might meet person to person sometime, and choose your words to me appropriately. you might be wrong about me. very very wrong. just saying.

Our constitution enshrines republicanism, federalism and democracy. Yes, democracy is at the very core of our founding. There is no pure democracy. It is too unwieldy and difficult to manage, as our founders well knew. In fact, many people decry the 17th amendment as implementing TOO MUCH Democracy in place of Republicanism. But yes, we ARE a Democracy, AND a Federal Constitutional Republic. Take away any one of those four and you no longer accurately describe the USA.

14th amendment does not apply, by its own terms, if parents were not citizens when a baby is born. See Article II and the 12th amendment

Your scheme is, in fact, surrender, bless YOUR heart.

“by insurrection i meant physical insurrection. for example something similar to kansas around 1860.”

How many cities were burned in Kansas in 1860? 50 to 60 people were killed and around a few hundred injured altogether over six or seven years from 1854. We’ve had at least half as many killed and many thousands injured this year (just one year) and far more property damage. ANTIFA being bussed around to instigate riots, cops being assaulted and shot, some killed and thousands injured. Threats of political violence and an attempt to overthrow our government. At least, in 1860, neither side was trying to overthrow the US government.

Giving the bad guys what they want so they don’t hurt you is pragmatic sometimes, like when you are significantly weaker, but from a position of strength, it is rank cowardice. You don’t get to give away the country, and that is literally what you are suggesting.

“i wonder if you are in the habit on person and if so whether you still have any front teeth left.”

Well, when I see cowardice I call it. Foolishness, too. If you want to know how many front teeth I have, why don’t you come count them?

Welp, Harris isn’t a top tier unless her inability to obtain a single delegate in her independent run for office (primary) counts as success.

President Trump won in a landslide so resigning would disregard the interests of about 3 of every 4 voters.

Presidentail resignation would concede all future elections to China, because Harris/Biden etc. are Chinese puppets and President Trump needs the assets of the US to halt corrupt elections..
So resigning would consign all future elections to the highest bidder and that’s China.

Americans don’t want to be enslaved or killed by the PRC. So, your proposal has nothing in it’s favor and eveything against it.

to my mind, the question would become, would biden be willing to admit a very big problem exists with the current election? or would he try to brute force his way from a broken election process?
~~~~~~~~~~~
Biden will do what his buyer tells him to do. His buyer, China will tell biden to continue to rip and claw at our country, tear it or burn it down through riots he foments if “necessary” but to never concede unless to elvate another Chinese puppet to the presidency.
i can already tell what kind of a person you are from a great distance. if you talk the way you write, then you don’t have them any more. either way, your character is on full display for all to see.
The basic problem with your solution is that we are under the rule of law and have suceeded when others agree to the Constitution and the rule of law.
Despots and Enemies trying to overtthrow our country have seized our electoral process and some of the candidates and are trying to batter us into submission so America will fall and be controlled by China/UN forces.
Any sort of compromise or concession will be devastating. No quarter, no retreat. President Trump won in an unprecedented land slide. That HAS to be enough for the republic.
