EXCERPT AND LINK TO CONGRESSIONAL RESEARCH—note the statement regarding line of succession going to Speaker of the House. In my various readings of articles by legal scholars, this has actually been challenged.
The Presidential succession act allegedly only applies when a President has been elected. If neither President or Vice President has been elected, then it would be President Pro tempore of the Senate.
In addition, in cases of fraud, there is the issue that the down ballot elections are also in question, and therefore, theoretically there would be no House elected. What would be left is the 2/3 of the Senate that did not stand for election this year.
